Section 6. Maintenance, Utilities, Taxes and <br />Assessments. <br /> <br /> During such time as the City is in possession of the <br />Demised Premises and Capital Projects I and II, all <br />maintenance and repair, both ordinary and extraordinary, of <br />Capital Projects I and II shall be the responsibility of the <br />City, which shall at all times maintain or otherwise arrange <br />for the maintenance of Capital Projects I and II in first <br />class condition, and the City shall pay for or otherwise <br />arrange for the payment of all utility services supplied to <br />Capital Projects I and II and shall pay for or otherwise <br />arrange for the payment of the costs of the repair and <br />replacement of Capital Projects I and II resulting from <br />ordinary wear and tear or want of care on the part of the City <br />or any other cause and shall pay for or otherwise arrange for <br />the payment of all insurance policies required to be <br />maintained with respect to Capital Projects I and II. In <br />exchange for the rentals herein provided, the Corporation <br />agrees to provide only the Demised Premises and Capital <br />Projects I and II. <br /> <br /> The City shall also pay directly or pay as <br />Additional Rental hereunder pursuant to Section 3(b), such <br />amounts, if any, in each year as shall be required by the <br />Corporation for the payment of all license and registration <br />fees and all taxes (including, without limitation, income, <br />excise, license, franchise, capital stock, recording, sales, <br />use, value-added, property, occupational, excess profits and <br />stamp taxes), levies, imposts, duties, charges, withholdings, <br />assessments and governmental charges of any nature whatsoever, <br />together with any additions to tax, penalties, fines or <br />interest thereon, including, without limitation, penalties, <br />fines or interest arising out of any delay or failure by the <br />City to pay any of the foregoing or failure to file or furnish <br />to the Corporation or the Trustee for filing in a timely <br />manner any returns, hereinafter levied or imposed against the <br />Corporation or Capital Projects I and II, the rentals and <br />other payments required hereunder or any parts thereof or <br />interests of the City or the Corporation or the Trustee <br />therein by any governmental authority. <br /> <br /> The City waives the benefits of subsections 1 and 2 <br />of section 1932 of the California Civil Code, but such waiver <br />shall not limit any of the rights of.the City under the terms <br />of this Lease. <br /> <br /> F-15 <br /> 1456S <br /> <br /> <br />
