Capital Project I under the terms and provisions of this <br />Lease. Such substantial completion shall be evidenced either <br />by a certificate of the Engineers or by the occupancy by the <br />City of Capital Project I. The time within which the <br />Contractor is required to complete Capital Project I shall be <br />extended for a period equal to any extensions of time to which <br />the Contractor is entitled under its construction contract <br />(except extensions resulting from acts of the Corporation) and <br />any delays in construction resulting from other causes and <br />events not within the reasonable control of the Contractor or <br />of the Corporation. <br /> <br /> The City may request the Corporation to issue change <br />orders altering the construction contract plans and <br />specifications during the course of construction, if such <br />changes do not materially reduce or diminish the capacity, <br />adaptability or usefulness of Capital Project I, and the <br />Corporation agrees to cooperate fully with the City to cause <br />such change orders to be implemented. Before the Corporation <br />shall issue any such change orders which, together with all <br />other change orders, would increase the aggregate cost of <br />construction of Capital Project I, the City shall arrange with <br />the Corporation to pay the increased cost resulting from such <br />change orders, and, if required by the Corporation or by the <br />terms of the Trust Agreement, shall deposit funds sufficient <br />to pay such increased cost with the Trustee. <br /> <br /> (b) The parties hereto agree that the City accepts <br />Capital Project II in its presently existing condition, and <br />further warrants and holds harmless the Corporation against <br />any defects presently existing therein. By entry hereunder <br />upon commencement of the term of this Lease the City accepts <br />Capital Project II as being in the condition in which the <br />Corporation is obligated to deliver Capital Project II to the <br />City. <br /> <br /> (c) The City shall have the right during the term <br />of this Lease to make alterations or improvements or attach <br />fixtures, structures or signs to the Demised Premises or <br />Capital Projects I and II if said alterations, improvements, <br />fixtures, structures and signs are necessary or beneficial for <br />the use of the Demised Premises or Capital Projects I and II <br />by the City, provided, however, that such actions by the City <br />shall not materially adversely affect the value of Capital <br />Projects I and II. <br /> <br /> Upon termination of this Lease, the City may remove <br />any fixture, structure or sign added by the City, but such <br />removal shall be accomplished so as to leave Capital <br />Projects I and II, except for ordinary wear and tear, in <br />substantially the same condition as they were in before the <br />fixture, structure or sign was attached. <br /> <br /> F-14 <br />1456S <br /> <br /> <br />
