The term "Written Request of the Corporation" means <br />an instrument in writing signed by or on behalf of the <br />Corporation by its President or its Vice President or its <br />Treasurer or its Secretary or by any other person (whether or <br />not an officer of the Corporation) who is specifically <br />authorized by resolution of the Board of Directors of the <br />Corporation to sign or execute such a document on its behalf. <br /> <br /> Section 2. Term; Commencement of Rental. <br /> <br /> The Corporation hereby leases to the City and the <br />City hereby hires from the Corporation, on the terms and <br />conditions hereinafter set forth, the Demised Premises and <br />Capital Project I to be constructed and located on Parcel <br />thereof and Capital Project II on the terms and conditions <br />hereinafter set forth and subject to all easements, <br />encumbrances, and restrictions that exist at the time of the <br />commencement of the term of this Lease. The City hereby <br />agrees and covenants during the term of this Lease that, <br />except as hereinafter provided, it will use Capital Projects I <br />and II for public and City purposes so as to afford the public <br />the benefits contemplated by this Lease. <br /> <br /> The term of this Lease shall commence on the date of <br />recordation of this Lease in the office of the County Recorder <br />of Alameda County, State of California, or on December 1, <br />1987, whichever is earlier, and shall end on February 28, <br />2009, unless such term is extended or sooner terminated as <br />hereinafter provided. If on February 28, 2009, the <br />Certificates shall not be fully paid, or if the rental payable <br />hereunder shall have been abated at any time and for any <br />reason, then the term of this Lease shall be extended until <br />ten (10) days after all Certificates shall be fully paid, <br />except that the term of this Lease shall in no event be <br />extended beyond February 28, 2019. If prior to February 28, <br />2009 all Certificates shall be fully paid, the term of this <br />Lease shall end ten (10) days thereafter or ten (10) days <br />after written notice by the City to the Corporation, whichever <br />is earlier. <br /> <br /> It is contemplated that the City will take <br />possession of Capital Project I on or before September 1, <br />1989. If Capital Project I shall be substantially completed <br />before September 1, 1989, the City may take possession of <br />Capital Project I upon such substantial completion. <br /> <br /> If the Corporation, for any reason whatsoever, <br />cannot deliver possession of the Demised Premises and Capital <br />Project I or any part thereof to the City by September 1, <br />1989, this Lease shall not be void or voidable, nor shall the <br />Corporation be liable to the City for any loss or damage <br /> <br /> F-4 <br />1456S <br /> <br /> <br />
