FACILITY LEASE <br /> <br /> (CAPITAL PROJECTS I AND II) <br /> <br /> This Facility Lease (Capital Projects I and II), <br />dated as of October 1, 1987, between the CITY OF PLEASANTON <br />PUBLIC FACILITIES CORPORATION, a nonprofit corporation duly <br />organized and existing under and by virtue of the laws of the <br />State of California (herein called the "Corporation"), as <br />lessor, and the CITY OF PLEASANTON, a municipal corporation of <br />the State of California (herein called the "City"), as lessee; <br /> <br /> WITNESSETH: <br /> <br /> In consideration of the mutual covenants hereinafter <br />contained, the parties hereto agree as follows: <br /> <br /> Section 1. Definitions. <br /> <br /> Unless the context otherwise requires, the terms <br />defined in this Section shall, for all purposes of this Lease, <br />have the meanings herein specified, the following definitions <br />to be equally applicable to both the singular and plural forms <br />of any of the terms herein defined: <br /> <br /> The term "Additional Rental" means all amounts <br />payable to the Corporation or the Trustee from the City as <br />Additional Rental pursuant to Section 3(b) hereof. <br /> <br /> The term "Corporation" means (i) City of Pleasanton <br />Public Facilities Corporation, acting as lessor hereunder; <br />(ii) any surviving, resulting or transferee agency; and <br />(iii) except where the context requires otherwise, any <br />assignee of the Corporation. <br /> <br /> The term "Base Rental" means all amounts payable to <br />the Corporation from the City as Base Rental pursuant to <br />Section 3(a) hereof. <br /> <br /> The term "Capital Project I" means a new water <br />reservoir and pipeline in the County of Alameda, California, <br />to be commonly known and designated as the Sycamore Water <br />Reservoir, to be located approximately 1300 feet northeast of <br />the intersection of Alisal Road and Sycamore Road, and to have <br />a capacity of approximately 8,000,000 gallons of water, <br />including all works, properties and structures comprising said <br />reservoir and pipeline, together with parking, site <br />development, landscaping, utilities, equipment, furnishings, <br />improvements and appurtenant and related facilities, all to be <br /> <br />1456S <br /> <br /> <br />
