PUBLIC HEARINGS AND OTHER MATTERS <br />22. Continued to February 6, 2007 a Public Hearing to consider recommendations <br />for use of Citizen's Option for Public Safety Program (COPS) appropriation and <br />adopt a resolution approving expenditures from the State of California COPS <br />program funds <br />23. Public Hearing: PAP-102, Pleasanton Village Association/Rohit and Sonia Gupta, <br />appellants PDR-561/PV-158, John Miller Architects/Saint Elizabeth Seton Church. <br />Appeal of the Planning Commission's approval of the applications for (1) design <br />review approval to modify the Saint Elizabeth Seton Church Master Plan to <br />construct an approximately 22,296-square-foot parish center building with <br />gymnasium and related site improvements on the existing Church site located at <br />4001 Stoneridge Drive; and (2) a variance from the Municipal Code to allow the <br />proposed parish center building with gymnasium to be approximately 34 feet tall, <br />where 30 feet is the maximum height limit allowed. Zoning for the property is <br />Agriculture. <br />The City Manager recused himself from discussion regarding this item as he is a <br />member of the Saint Elizabeth Parish. <br />Jerry Iserson, Director of Planning, gave the staff report describing the project in <br />greater detail and noted at issue is whether Saint Elizabeth Seton Church should <br />be allowed to modify their 1998 master plan to relocate the siting of some of the <br />future buildings and be granted approval for the design of the parish center <br />building, including a height variance. The Pleasanton Village Association and <br />Rohit and Sonia Gupta have expressed concerns with the traffic, parking, and <br />noise. The Planning Commission approved the applications; subject to a <br />substantial number of conditions of approval to help ensure that the parish center <br />building would fit in with the neighborhood and be an asset to the community. The <br />applicants are in agreement with the Planning Commission's conditions of <br />approval. As proposed by the applicants and conditioned by the Planning <br />Commission, staff believes that the master plan modification and parish center <br />building design will not detrimentally affect the surrounding properties. Staff also <br />believes that the required variance findings can be made and that granting the <br />height variance would not create adverse impacts on the adjacent properties. <br />Staff recommended that the City Council uphold the Planning Commission's <br />approval of the design review and variance applications by taking the following <br />actions: <br />Make the Variance findings as listed on pages 20-21 of the Planning <br />Commission staff report; <br />2. Adopt the draft resolution denying the appeal and, therefore, approving Cases <br />PDR-561 and PV-158, subject to the conditions listed in Planning <br />Commission Resolution No. PC-2006-62; and <br />City Council Minutes 5 January 16, 2007 <br />
