She questioned if there are other commercial buildings on Rheem Drive that could be approached by the church to see if additional overflow parking could be secured. She added this is a conditional use permit and she believes the church is going to grow. She believes there are other factors, besides Rheem and Stoneridge, in which the church could get additional parking for future growth. Councilmember McGovern clarified that the Council could ask that the church look at trying to reduce the height of the gymnasium as much as possible through the conditions on the project. She questioned if the Council could ask that the Pastoral Council form a liaison person to the HOA and meet with the HOA as part of the conditional use permit to identify ongoing problems. She also asked that a condition be added to address that once the building is in use, that decibel studies be done to ensure they are within the condition of 60 decibels. Lastly, she indicated she hopes that by looking at these issues, a dialog continues to show good faith to the community through addressing traffic, noise and parking. Mayor Hosterman clarified there have not been any significant noise complaints at St. Elizabeth's. She also clarified significant funding is in place for the church to move forward with construction this summer, but they are still looking for a response on a loan from the Diocese. Councilmember Sullivan voiced continued concern regarding the lack of environmental review on this project which, if done, would identify traffic and noise problems. He noted parking and safety issues. He additionally stated he feels it is important that the Council have the benefit of the full discussion of the Planning Commission by waiting for the approved minutes. He is supportive of being flexible, but in this case he feels the flexibility has been for the benefit of the church and to the detriment of the neighbors. He would like to see a balance for the use that the church wants with the impacts to the neighbors, especially since the plan is being changed. He did not feel the issues of the neighbors have been addressed adequately. Councilmember Sullivan proposed utilizing afacilitator/mediator to work with the church and the neighbors. Motion: It was moved by Sullivan to uphold the appeal. Due to the lack of a second, the motion failed. Councilmember Thorne indicated he feels the church has done an outstanding job in responding to the neighbor's concerns and would not support delaying this project any further. He feels there has been sufficient time to work with the neighborhood. The parking situation should work, or it can be revisited. He indicated he supports staff's recommendation and would also support the conditions that Councilmember McGovern wanted to add to the project. He City Council Minutes 10 January 16, 2007
