<br />City Attorney Roush reported that the Council authorized the City manager to send a <br />letter to Mr. Wagner informing him that the terms of the Settlement Agreement would <br />not be extended; as to the second Wagner matter, the Council directed that the claim <br />be rejected. <br /> <br />Mayor Hosterman adjourned the meeting to closed session at 11: 15 p.m. for the following <br />purpose: <br /> <br />9b. Existing Litigation - Pursuant to Government Code ~54956.9(a): <br />. York Bridge v. Forsgren Associates and related cross complaints (Ferma Claims) <br />Case #VG05194131 <br /> <br />. City of Pleasanton Alameda County Superior Court Case No. <br />RG04177067 <br /> <br />The meeting reconvened in open session at 11 :43. City Attorney Roush reported the following <br />action taken in closed session: As to the Ferma claims, the Council authorized settlement by <br />the payment of an additional $4.2 million above that which has already been paid to Ferma. <br />Concerning Urban Habitat, the Council authorized retaining the law firm of Hanson Bridgett to <br />assist in the City's defense of this matter. With regard to Manzella, the Council authorized <br />settlement of the case by the payment of attorney's fees in the amount of $200,000 plus costs of <br />$1500. <br /> <br />10.
