<br />Ms. McGovern believed there were two pieces of land in Pleasanton where daycare <br />facilities could be built: one on the Bernal property and the other in the Vineyard Corridor next to <br />the School site. <br /> <br />Mr. Iserson said that was correct. He also noted there is another piece of land that is a <br />possibility, which is located on Dublin Canyon Road. <br /> <br />Ms. McGovern was hopeful that information pertaining to these sites could be provided <br />to the public. She inquired about the land on the Bernal property and said it was her <br />understanding that someone could build a facility and lease the land for $1.00 per year. <br /> <br />Mr. Filaho said the condition for the land on the Bernal property is that it must be used <br />for public use. <br /> <br />In response to an inquiry by Ms. McGovern, Mr. Fialho said the motion could include <br />directing staff to conduct a public review process with notification provided to the neighborhood <br />to enable staff to review the large family daycare facility after 12 months of operation to <br />determine compliance with the conditions of approval. After conducting the review and <br />receiving public input, the Planning Director shall make a determination of compliance and may <br />add or modify conditions of approval if consensus for such changes is reached between the <br />daycare operator and the neighbors. If the Director determines that the facility is not in <br />compliance, or if there is not consensus regarding compliance or with changes to the conditions <br />of approval, the use permit shall be referred to the Planning Commission for review. In addition, <br />the motion could include directing the City's Traffic Committee to work with the Valencia <br />neighborhood in an effort to promote traffic safety and provide traffic calming measures. <br /> <br />Ms. McGovern indicated her desire to have the Police Department work with the <br />Valencia Homeowners Association regarding the issue of traffic enforcement on the <br />neighborhood private streets. <br /> <br />It was moved by Ms. McGovern, seconded by Mr. Thorne, to adopt Resolution 06- <br />010, a resolution upholding the appeal of Megha Vilas Thuse, thereby approving <br />application PDUP-8, subject to the Conditions of Approval as listed in Exhibit B with the <br />following modifications: (1) the use permit shall be subject to a review process by the <br />Planning Department following twelve months of operation; and (2) the neighborhood <br />traffic issues shall be referred to the Traffic Committee for review and recommendations <br />regarding traffic safety and traffic calming, including the possibility of the City's <br />enforcement of the Vehicle Code within the development's private streets. <br /> <br />The roll call vote was taken as follows: <br />AYES: Council members - Brozosky, McGovern, Sullivan, Thorne, and Mayor <br />Hosterman <br />NOES: None <br />ABSENT: None <br />ABSTAINED: None <br /> <br />Pleasanton City Council <br />Minutes <br /> <br />15 <br /> <br />02/07/06 <br />
