Mr. Iserson said there are eight 15-gallon trees which block the Crofton's expansion from
the Diazs' view.
In response to an inquiry by Mr. Sullivan, Mr. lserson suggested that the trees be
planted in the area of where the new deck would be located. Staff suggested planting 15-gallon
trees.
Ms. McGovern was concerned about privacy and wanted the trees to be at least 15-tall
Evergreen trees to provide year round privacy.
Mr. Sullivan believed the trees the Croftons were planting would not block their
expansion for a long period of time. He would support Ms. McGovern's proposal with the
exception of requiring 24-inch box trees.
Mr. Thorne concurred with Ms. McGovern's proposal.
It was moved by Ms. McGovern, seconded by Mr. Sullivan, to adopt Resolution 05-
079, a resolution upholding the appeal thereby approving the design review application
of the Diazs with the following modified condition: within six months of the issuance of
the building permit for the addition, or by the time the addition is ready to be given final
approval by the Building Department, whichever occurs first, the Diazs are to construct
on their common property line with the Croftons a new seven foot fence, similar in
design and compatible with the fence the Croftons have already constructed on other
sides of their property. The design of the fence is to be approved by the Planning
Director, taking into consideration the input of the Croftons. The cost of the new fence
will be shared equally between the Diazs and the Croftons.
The roll call vote was taken as follows:
AYES: Councilmembers - Brozosky, McGovern, Sullivan, Thorne, and Mayor
Hosterman
NOES: None
ABSENT: None
ABSTAINED: None
Ms. McGovern wanted to ensure the three trees were at least 15-gallon Evergreen trees,
15 feet in height.
Mr. Iserson said it would be better to simply require 15-feet tall Evergreen trees.
It was moved by Ms. McGovern to require the Diazs to plant three 15-gallon tall
Evergreen trees, 15 feet in height on their property to provide additional privacy.
Mr. Sullivan believed conditioning 24-inch box trees was too much and had a difficult
time imagining a 15-gallon tree that is 15 feet in height.
Ms. McGovern said the idea was to provide additional privacy.
Pleasanton City Council 11 10/18105
Minutes
