<br />Mr. Iserson recalled hearing there were other small daycare centers in the <br />neighborhood; however, pointed out that staff does not regulate small daycare facilities and <br />would not be aware of it. <br />Mr. Sullivan believed there were two to three additional home daycare centers in <br />operation on Paseo Navarro. He believed the Pleasanton Municipal Code stipulated that no <br />large family daycare homes should be approved if the site is within three hundred feet of <br />another large daycare center. <br />Mr. Iserson said that was correct. <br />Mayor Hosterman believed what was being discussed was a cumulative or an aggregate <br />impact with additional daycare centers within the same neighborhood. She asked staff if there <br />was any way to measure it? <br />Mr. Iserson pointed out that staff does not regulate small family daycare facilities and is <br />not aware of their locations because it does not keep track of these facilities. It would be a case <br />of observation and if there were significant amount of traffic associated with those facilities. <br />Ms. McGovern pointed out that page six of the staff report stated that State law and City <br />Code define large family daycares as accommodating between seven and fourteen children, <br />and the Sutton's daycare facility is currently at eight children. She believed the Sutton's <br />daycare center was not currently a small daycare center but a large daycare center. <br />Mr. Iserson pointed out that there are provisions for small daycare centers for up to eight <br />children and there is a bit of an overlap, which is attributed to State guidelines. <br />Based on the staff report, Ms. McGovern's definition of a large family daycare facility <br />included the Sutton's. She believed the 45-day condition of a meeting between the appropriate <br />City representatives, the neighbors and the applicants was an overly cumbersome condition. <br />She did not believe there would have been a three-two vote at the Planning Commission level <br />without this condition, and removing this condition would be removing a condition that was <br />important for the original vote. <br />Mr. Brozoskyasked if the distances that large family daycare centers need to be apart is <br />300 feet? <br />Mr. Iserson said yes. <br />Mr. Brozosky recalled that when a Conditional Use Permit is issued, it is based on the <br />land so that the first person within any neighborhood that is issued this permit would mean that <br />no other large family daycare center for the rest of its life could locate another large family <br />daycare center within 300 feet of it? <br />Mr. Iserson said Conditional Use Permits run with the land and if staff becomes aware <br />there is no large family daycare center in operation, the use permit could always be rescinded. <br />Mr. Brozosky asked if any conditional use permit could be revoked? <br />Mr. lserson said that in order to revoke a conditional use permit, a public hearing <br />process would need to be conducted prior to rescinding the conditional use permit. <br />Pleasanton City Council 5 1 0/04/05 <br />Minutes <br />
