He requested a round table meeting be held to <br />discuss tennis services in the community. <br /> James Frost, a Pleasanton resident, requested Council consider regulating sports courts <br />as accessory structures. <br /> In response to a request by Ms. Hosterman, Mr. Roush informed Council that a lawsuit <br />has been filed by the Frosts against the Sweeney's and Greenbriar. The matter is pending in <br />Superior Court. <br /> Written communication was presented to Council from Stephen Woodward, a <br />Pleasanton resident, expressing his opposition to the elimination of bicycle lanes from the City's <br />roadways. <br /> There were no other speakers. <br />6. PUBLIC HEARINGS AND OTHER MATTERS <br />6a <br />AdoDtion of a 45-dav moratorium on medical mariiuana disDensaries (SR 05:128) <br /> Tim Neal, Police Chief, presented the staff report. <br /> Mayor Hosterman wanted it made clear that Council is not discussing the merits of <br />medical marijuana dispensaries. Council is considering a short moratorium in order to address <br />the community's concerns regarding appropriate guidelines and/or an ordinance so that the City <br />may be able to accept applications for permitting for these types of facilities in the future. <br /> Mr. Neal said the moratorium deals specifically with dispensaries and has no impact on <br />Proposition 215; the use of marijuana by Pleasanton citizens for legitimates medicinal reasons. <br />The proposed moratorium deals strictly with the opening of a medicinal marijuana dispensary. <br /> Mayor Hosterman noted that other Tri-Valley municipalities are contemplating passing <br />similar moratoriums. <br /> Mr. Neal said that in discussing this issue with the Police Chiefs from Dublin and <br />Livermore and because of the problems encountered in the greater East Bay, the Chiefs were of <br />the belief that the right thing to do is to approach this jointly in order to avoid passing the <br />problem to its neighboring city. <br /> Mr. Brozosky mentioned the staff report discussed the merits of medical marijuana, <br />which he wanted to avoid discussing. <br /> Mr. Neal noted that justice publications tend to dwell on the legalities of the issue. It is <br />not staff's intent to deny or diminish the validity that marijuana can be medicinal. In Pleasanton <br />amongst youth, it is second to alcohol in abuse substances. While marijuana may have merit <br />for those who are ill, it is clearly a drug and one that is toxic and one that needs to be strictly <br />controlled and regulated. He was concerned that a dispensary open without restrictions in <br />Pleasanton could have an impact on the youth in this community and the community in general. <br />Pleasanton City Council 5 08/16/05 <br />Minutes <br />
