Mr. Roush agreed. Just because a Housing Element does not have certification, <br />it does not mean the Housing Element is deficient. <br /> <br /> Mayor Hosterman felt that even though the City may be challenged in the future, <br />as policy makers, Council must make quality of life decision for the citizens of <br />Pleasanton. <br /> <br /> Mr. Brozosky noted that the City only received conditional approval of the <br />Housing Element and that has been revoked. So since there has never been an <br />approved Housing Element, the City is not committed to the housing unit numbers. <br /> <br /> Mr. Roush clarified there has not been an HCD approved Housing Element. But <br />there is a Council-approved Housing Element which staff looks at when evaluating any <br />number of development projects that come along. If Council wishes to change that, it <br />must follow the regular procedures to do so. <br /> <br /> Mr. Brozosky asked if AB 2292 referred to a State approved Housing Element or <br />a Council approved Housing Element? <br /> <br /> Mr. Roush believed it was an HCD approved Housing Element. <br /> <br /> Mr. Brozosky felt the AB 2292 elements about rezoning may not apply to <br />Pleasanton if it does not have an HCD approved Housing Element. <br /> <br /> Mr. Roush was not comfortably taking that position, but all things are possible in <br />law. <br /> <br /> Mr. Brozosky asked if the conditional approval of the Housing Element from <br />ABAG met the full housing needs set forth by ABAG? <br /> <br /> Mr. Iserson said it would have. <br /> <br /> Mr. Brozosky believed that the City was not committed to rezoning. It must go <br />through the process and identify areas, but did not have to commit to those numbers. <br /> <br /> Mr. Iserson said the City is committed to rezoning, however no city actually <br />achieves the ABAG numbers. That is a goal to strive toward and to develop a way to <br />get there. <br /> <br /> Mr. Brozosky asked if the City rezoned property and then found that based on <br />other policies in the General Plan, such as withholding building permits when the City <br />finds the level of service in the cimulation plan goes below LOS D, then that could <br />override approval of units on proper~ that has been rezoned? <br /> <br /> Mr. Iserson said it is important to have a General Plan that is internally <br /> consistent, but just because land is rezoned, it does not mean development will be <br /> approved in that location. The rezoning has to be done to have the land available, but it <br /> is up to the market and Council to see if anything gets built. <br /> <br /> Joint Workshop <br /> City Council and Planning Commission 3 05/24/05 <br /> <br /> <br />
