Ms. McGovem was concerned about the contract not including the requirement oi an <br />annual financial statement audit. <br /> <br /> Mr. Wolfe noted the contract states that the City may require Lifetime Tennis, Inc. to <br />submit audited financial statements because the City collects all of the revenues. If the contract <br />was modified and Lifetime Tennis Inc. was making the reservations and collecting the revenue, <br />it would then be appropriate to require submittal of audited financial statements for the operation <br />of the Facilities. <br /> <br /> In response to an inquiry by Mr. Brozosky, Mr. Wolfe verified that the City collects <br />revenues received from the proshop. <br /> <br /> Ms. McGovern was hopeful that the Parks and Recreation Commission could review and <br />provided a recommendation with respect to the additional four courts that shall be reserved for <br />drop-in/open play during weekday evenings and weekend mornings, particularly as it pertained <br />to league play. She wanted the community to be assured and know the exact amount of courts <br />that are truly available for players to reserve within a 48-hour period for play. <br /> <br /> Mr. Sullivan asked that staff work with the Tennis Operator to effectively advertise the <br />establishment of the Pleasanton Community Tennis Association. <br /> <br /> In response to an inquiry by Mr. Brozosky, Mr. Spiller said the tennis players are not a <br />part of the Sports Council. Once the Pleasanton Community Tennis Association is established, <br />he believed it would be appropriate to include it as part of the Sports Council. <br /> <br />The roll call vote was taken as follows: <br />AYES: Councilmembers - Brozosky, McGovern, Sullivan, and Mayor Hosterman <br />NOES: None <br />ABSENT: None <br />ABSTAIN: None <br /> <br /> There was a break at 10:06 p.m. <br /> <br /> The meeting reconvened at 10:14 p.m. <br /> <br />6._.~e <br />Approval of a sale and purchase aqreement for 4254 Vervais Avenue. (SR 05:133) <br /> <br /> Steven Bocian, Deputy City Manager, presented the staff report. <br /> <br /> Mr. Brozosky asked what the approximate cost would be for the improvements for this <br />property and if this property had any sewer access? <br /> <br /> Mr. Bocian believed the improvement costs would be approximately $200,000. This <br /> property has a septic tank and no sewer access. <br /> <br /> If the City purchased 4254 Vervais Avenue, Mr. Brozosky asked if the City would be <br /> obligated to purchase 4230 Vervais Avenue as in the Downtown Specific Plan this property is <br /> designated Park. <br /> <br /> Mr. Bocian said the City has no obligation to purchase either 4254 or 4230 Vervais <br /> Avenue. The City has received no indication that the owner of 4230 Vervais Avenue is selling <br /> its property, nor has staff made any recommendation to attempt to purchase this property.
