Association events are hosted at this Facility each year in addition to the East Bay Athletic
League Playoffs. He believed the contract neglected to ask or require Lifetime Tennis, inc. to
agree to host these events.

Mr. Wolfe reminded Council that the Amador Tennis Courts were removed in order to
provide for more parking while additional courts were being built. At that time, the City provided
the availability of tennis courts at the Tennis and Community Park to the Amador High School
team, which became their home site for both the girls and boys teams. He did not believe this
was a conflict. He noted that the City has the option each fiscal year to renew this contract.
The terms of the contract provided the City the option to not renew the contract or cancel it if
there are concerns.

Mr. Sullivan pointed out that Section 10.0 of the contract references default and breach
of the Agreement if tennis revenues are less then $175,000 for an operating year.

Mr. Wolfe said current expenses are $259,000 and $295,000 is generated in revenue.
The City is subsidizing tennis for $35,000. Staff has reduced the costs of items that the City is
not obligated to pay for, which are included as part of the contract. Lifetime Tennis, Inc.,
receives 80 percent of the actual revenue. The City is close to or has reduced the City subsidy
for tennis by entering into this contract with Lifetime Tennis, Inc. He mentioned that revenues
have increased and overall expenses have decreased.

Mr. Fialho said the City's seasonal employee is an hourly employee with no benefits. He
would be surprised if the costs exceeded $25,000 to $30,000 per year.

Mayor Hosterman asked if Lifetime Tennis, Inc., could continue to host the East Bay
Athletic League Playoffs?

Mr. Gill said staff would approve all schedule and usage pertaining to the tennis courts.
He agreed to extend participation to host the East Bay Athletic League Playoffs as well as any
other activities that the community desires. He noted that there are many opportunities for the
Facility to be used. He noted that USTA was stated incorrectly in the contract. The correct
wording should have been the United States Professional Tennis Association (USPTA), which is
one of the two bodies that award certification for tennis professionals.

Mr. Wolfe said the agreement could be modified to include this change.

Mr. Gill mentioned that the Pleasanton Community Tennis Association was not in
existence; however, it was part of his proposal. He has been involved in starting other
community tennis associations, which have been well received, it was his intention to begin this
type of association in Pleasanton and attend the meetings. Based on his background and
understanding, the league program is a lesson program and the courts that would be reserved
for league play would be the courts that are accessible for reservations or drop-in play. He
noted that many other municipal facilities offer leagues and reserve courts for this purpose. He
noted that thera would be additional courts designated for tennis lessons or open play where no
reservation would be required. He was willing to work with the community and staff to
accommodate the needs of how many courts should be designated if additional courts were
needed for league programs.

Mr. Brozosky noted that the term of the proposed contract is four years. He asked if the
extension of the contract was beyond the four-year term?

Pleasanton City Council 15 05/17/05
Minutes
