considerably. She wanted to move away from this direction and protect the quality of life in the Tri-
Valley, particularly the Happy Valley area.

Mr. Brozosky could not support this condition since he was not clear about the lighting
standard.

The roll call vote was taken as follows:
AYES: Councilmembers - Brozosky, McGovern, Sullivan, and
Mayor Hosterman
NOES: None
ABSENT: None
ABSTAIN: None

Ms. McGovern reiterated that she supported the motion because the applicant was
comfortable with the conditions that were added to the motion,

6__e
Approval of Amendment No. I to the consultant aqreement with Rasmussen Planninq~ Inc.
(CM-04-127), for the Bernal Property Project. (SR 05:074)

Mr. Fialho presented the staff report,

Ms. McGovern asked who would be doing this work if Mr. Rasmussen were not asked to
continue the additional work?

Mr. Fialho said the work would be assigned to staff in the Planning Department. He pointed
out that the General Plan update requires an equal amount of energy as well as the preparation of the
Draft Bernal Property Phase II Specific Plan and the processing of the Bernal Community Park Phase
I PUD plans. The City's Principal Planner who is coordinating the update of the General Plan is
occupied with this effort and staff needs assistance from the outside from someone who is capable
and knowledgeable about the project.

Ms. McGovern asked if the consultant provided professional planning services to the City with
some direction from staff.

Mr. Fialho said yes. lie indicated that he has scheduled weekly meetings with Michael
Fotheringham, Wayne Rasmussen and the Director of Planning and Community Development to
coordinate the project and discuss logistics, strategy and approach.

Mr. Brozosky believed the reason Mr. Matin requested that this item be pulled from the
Consent Calendar was because he believed the consultants were pushing a particular agenda or
certain ideas. He believed the City needed to make it clear when there are meetings regarding the
Bernal property that the consultants and/or staff presenting the information are neutral and are not
providing opinions, and are encouraging discussion as opposed to discouraging it.

Mr. Fialho said staff has had this discussion internally. He informed Council about his
conversation with Mr. Matin this afternoon. He informed him that staff is playing the roll that Mr.
Brozosky described. If the consultants are asked their preference, they will provide their respective
opinions. Staff will not manipulate the process. The intent is to deliver a great product for this
community and to encourage community input, which ultimately drives what the Bernal property looks
like in the end for Council and ultimately, the community.

Pleasanton City Council 23 04/05/05
Minutes
