Ms. McGovern pointed out that Longview Drive is mentioned on the 2005 City Weed <br />Abatement list with no specific address. (SR 05:093) <br /> <br /> Jerry Iserson, Director of Planning and Community Development, presented the staff report. <br /> <br /> Mr. Brozosky asked how long staff worked with the property owners and if they had been <br />aware of these problems. <br /> <br /> Mr. Iserson said the property owner has been aware of the problems. Staff has concentrated <br />its efforts in addressing these problems with the tenant since he was directly involved. <br /> <br /> Darrin Davis, Police Lieutenant, informed the Council that he was assigned as the Police <br />Sergeant to the Code Enforcement Division as the Senior Code Enforcement Officer in 1999. From <br />the period of 1999 to 2003, the tenant was the primary contact and the majority of the problems were <br />police related, and not the tenant problems as noted in the staff report. The problems were primarily <br />with the Richard Ressler, the owner of the Union Jack Pub. In 2003, an official letter was sent to the <br />property owner. Since that time, the property owner has switched hands to a family member, who <br />now owns the property. <br /> <br /> In response to an inquiry by Mr. Brozosky, Mr. Iserson said the US Bank and Mr. Beratlis <br />commonly own the fence. <br /> <br /> Mr. Brozosky asked if Council had the latitude to waive the conditional use permit? <br /> <br /> Mr. Roush said the conditional use permit could not be waived without amending the Zoning <br />Ordinance. The Ordinance is clear that if a conditional use permit is revoked, a similar or a <br />substantially similar application cannot be submitted within that year's period of time. Given the <br />length of time it takes to get a use permit approved, a person could start the process within the year. <br />He advised Council to observe the one-year requirement, which is included in the Zoning Ordinance <br />for a reason. <br /> <br />Pleasanton City Council 10 04/05/05 <br />Minutes <br /> <br /> <br />
