6. PUBLIC HEARINGS AND OTHER MATTERS <br /> <br />Item 6a <br />PUD-42/PSP-81 Earl Bach, Karen Bach, Ed Lamb. Sr.. and Ed Lamb. Jr. (SR 05:069) <br />Application for PUD development plan approval to allow a four-lot development plan for <br />three new homes and for an amendment to the North Sycamore Specific Plan to <br />consider eliminating a public sidewalk connection between Sycamore Terrace and San <br />Carlos Way for a 1.84-acre site located in the North Sycamore Specific Plan area. <br />Zoning for the property is PUD-LDR (Planned Unit Development - Low Density <br />Residential) District. <br /> <br /> Jerry Iserson, Director of Planning and Community Development, presented the <br /> staff report. <br /> <br /> Mr. Brozosky asked if the North Sycamore Specific Plan identified the trail <br /> connections before any homes in North Sycamore were built. <br /> <br /> Mr. Iserson said the trails were approved as part of the North Sycamore Specific <br /> Plan before the new homes were built. <br /> <br /> Mr. Brozosky asked if there were any issues pertaining to ADA compliance? <br /> <br /> Mr. Iserson noted that staff considered options to achieve ADA compliance and <br /> concludes that such compliance is not feasible. Staff notes that Council would have to <br /> make the finding that it is not feasible for the public sidewalk to meet ADA standards if it <br /> wants the sidewalk connection to be built. <br /> <br /> Mayor Hosterman declared the public hearing open. <br /> <br /> Ed Lamb, Jr., applicant, said he planned to build a home for his family on one of <br /> the subdivided lots. When he first completed the design for the Planned Unit <br /> Development (PUD), he had no intention of asking for the removal of the sidewalk, as it <br /> was part of the North Sycamore Specific Plan. After speaking with his neighbors, he <br /> believed that they had presented valid reasons to warrant consideration for removal of <br /> the sidewalk. He believed this was the only opportunity to provide them a chance to be <br /> heard. <br /> <br /> Mojgan Bozorgzad, a Pleasanton resident, did not believe the sidewalk would be <br /> a safe pedestrian pathway. She expressed her concern about the liability of the public <br /> path as well as the safety of children bicycling on the steep path. She noted that her <br /> privacy would be invaded, as pedestrians using the pathway would have a direct view <br /> into her home. <br /> <br /> Hoss Bozorgzad, a Pleasanton resident, noted that he and his wife pumhased <br /> their property in 1994 with the intention of building a new home and tennis courts, and <br /> using the existing house as an in-law unit. His plans changed. He noted that this project <br /> had a ten-year history that had become problematic, and detailed its history. He <br /> expressed concam related to safety issues, particularly related to liability and wondered <br /> how the path would be designed so that it does not create community liability.
