Mr. Brozosky asked the appellants what hours of operation would be acceptable?

Ms. Sauter said the hours of operation that would be acceptable are 10 p.m. on
weekdays and midnight on Friday and Saturdays. She and her husband believe
infrastructure is the biggest issue with respect to parking. If this was handle properly
and patrons were guaranteed not to park in front of their home it would be different.

Mr. Brozosk-y asked the appellants if any restaurant at 336 St. Mary's Street
would be acceptable?

Ms. Sauter said a restaurant is a fine usage. She believed the infrastructure still
must be considered in future decisions of the City Council, Planning Commission and
the Pieasanton Downtown Association.

Marl Kennard, applicant and a Pleasanton resident, believed staff has adequately
described her business as a quality business to the downtown. She is bringing to the
downtown a family-dining establishment. The Oddfellows British Pub and Restaurant
will cater to families with children and seniors and it will be a quality operation. The food
and beverages are value priced. She noted that it would cost a great deal to bring this
dilapidated building into a beautiful building that Pleasanton can be proud of. For her to
spend a great deal of money to completely renovate the building, she needs to have
flexibility to use her establishment to the fullest of its ability, and make every possible
use she can of this facility. She needs the additional revenue to make her business plan
work. This establishment is a small business and she is taking a personal risk and
- -~ making a personal investment, and she needs to know that she has the ability to bring in
extra revenue on Friday and Saturday evenings. She asked Council to trust her and her
integrity to be a good business in Pleasanton, and allow her to proceed with her
business plan as laid out, which is supported by the Planning Commission and staff.

Mr. Sullivan asked Ms. Kennard if she is willing to compromise on the allowable
hours of operation and close her business at 10 p.m. on the weekdays and at I a.m. on
Friday and Saturdays?

Ms. Kennard said these hours of operation would not work for her business.

Roy Moret, a Walnut Creek resident, advised that he owned and managed the
Los Pilares building at 739 Main Street and supported the proposed project. He strongly
urged continue monitoring of the conditions if approved. He believed the conditions
would serve the good of the community and believed the use would be beneficial to
downtown Pleasanton. He noted that his tenants had experienced numerous incidences
of vandalism and harassment resulting from their proximity to the Union Jack Pub. He
urged Council to require an additional review upon each change of management or
ownership. He asked Council to take immediate steps to bring the Union Jack Pub into
compliance with its Conditional Use Permit of 1988.

Robert Byrd, a Pleasanton resident, appreciated Ms. McGovern for taking the
time to visit the project. He asked Council to support this project, as a vast majority of
_ . people that live and/or support the downtown would like to have this project.

Carl Palowitch, a member of the Board of Directors of the Pleasanton Chamber
Commeme, Pleasanton resident and small business owner, said that as a resident, he

Pleasanton City Council 16 02/01/05
Minutes
