Mr. Etnire said the Specific Plan does not include a sample of the actual <br />easement and the disclosure. Both of these documents are attached to the recorded <br />development agreement. <br /> <br /> Ms. McGovern believed it would behoove the City when it is working on a <br />contract with the builder to require that certain disclosures be included in the buying of <br />the homes, particularly disclosing that a rubber asphalt plant is located within a 100 feet. <br /> <br /> Mr. Etnire said his firm would support this disclosure and would help write it. <br /> <br /> Ms. McGovern asked if December 10, 2004 is the drop-dead date to finalize the <br />sale of the property to Centex Homes? <br /> <br /> Mr. Etnire said escrow needs to close on December 10, 2004 as RMC has <br />tentatively been sold to another international company. <br /> <br /> It was moved by Me. Hoaterman, seconded by Mr. Sullivan, to adopt <br />Resolution 04-096, a resolution tentatively cancelling the Williamson Act contract <br />on about 21.5 acres within the Vineyard Avenue Corridor Specific Plan. <br /> <br /> Mr. Brozosky asked Council to consider revising the resolution to omit the <br />wording that states that there is a job/housing imbalance. <br /> <br /> Mr. Roush said this wording could be omitted. This paragraph could just state <br />that it will add housing consistent with the City's General Plan and Growth Management <br />Plan. <br /> <br /> Mayor Hosterman and Mr. Sullivan agreed to this change. <br /> <br /> Mayor Hosterman publicly stated that Council and staff are adamantly in favor of <br />seeing the asphalt plant moved. <br /> <br /> Ms. McGovern thanked RMC for the work it did with the School District and the <br />City to help put in the new Vineyard Avenue realignment. She hoped that RMC would <br />continue to work with the City on the issue of the asphalt plant. <br /> <br /> Mr. Etnire said he would continue to work with the City. <br /> <br />The roll call vote was as follows: <br />AYES: Councilmembers - Brozosky, McGovern, Sullivan, and <br /> Mayor Hosterman <br />NOES: None <br />ABSENT: None <br />ABSTAIN: None <br /> <br />9.
