Mr. Campbell believed that ii the asphalt batch plant was a nuisance it was one <br />thing, but if the Company is violating laws and ordinances it is another thing. <br /> <br /> Mayor Pico did not believe itlwas significant to Council's request to leave the last <br />two sentences in paragraph four of the letter. <br /> <br /> Ms. Ayala accepted the amendment to modify the first sentence of the letter and <br />suggested checking the accuracy of the last two sentences in paragraph four. <br /> <br /> Instead of omitting the last tWO sentences in paragraph four of the letter, Mayor <br />Pico suggested stating "it is Council'~ understanding that in October 2003, Granite <br />Construction/RMC Pacific Materials iwere directed by the County to remove the plant <br />because the plant's current location Was a nuisance. The plant, however, has not been <br />removed." <br /> <br />Ms. Hosterman and Ms. Ayala accepted Mayor Pico's suggestion. <br /> <br /> It was moved by Ms. Ayala~ seconded by Ms. Hosterman, to authorize Mayor <br />Pico to send a letter to the Alameda County Planning Commission expressing the <br />City's position that the asphalt plant be removed from its current location, with <br />modifications to the first sentence of the letter and to the last two sentences in <br />paragraph four as recommended I~y Mayor Pico. <br /> <br />The roll call vote was taken as follows: <br />AYES: Councilmembers - Ayala, Hosterman, and Mayor Pico <br />NOES: Councilmember campbell <br />ABSENT: None <br />RECUSED DUE TO A CONFLICT OF INTEREST: Councilmember Brozosky <br />ABSTAIN: None <br /> <br />6b <br />PAP-66 (PCUP-112)~ Mary Kay B~rg~ Achievement Learning Center <br />Appeal of the Planning Commission, s approval of an application for conditional use <br />permit to operate a private tutorial school in the existing building located at 231 Old <br />Bernal Avenue, Suite 1. Zoning for the property is "O" (Office), Downtown <br />Revitalization District. (SR 04:181) <br /> <br /> Mayor Pico noted that Ms. Berg appealed this matter at Council's last meeting. <br />She then asked that the appeal be rescinded, and then asked that the appeal be allowed to <br />proceed. Ultimately, Council is in possession of a letter from Ms. Berg stating that her <br />issues with the City have been resolx~ed and there is no longer a need to appeal the <br />conditional use permit decision. Therefore, she withdrew her appeal. <br /> <br /> Mayor Pico opened the public hearing.
