Ms. McKeehan said that this project had nothing to do with the amount of the <br />fees. <br /> <br /> Ms. Ayala said that the information she was referring to was when Ponderosa <br />Homes first came to Council for the bonds and tax credits. All of the financing was <br />perfectly clear to her, and she agreed with Mr. Brozosky that a decision in the matter <br />should be made this evening. She believed that Council would set a precedent for <br />developers to come back to Council repeatedly if it gave Ponderosa Homes the <br />opportunity to come back to Council and/or the Planning Commission for consideration <br />of a partial fee waiver. <br /> <br /> Mr. Brozosky said that if Council did not make a decision this evening, it should <br />do so at its next meeting. He did not believe it made sense for the developer to come <br />back to the Council and/or the Planning Commission three or four months from now. If <br />Council does not have all of the information it needs now, it should postpone that part of <br />the decision until it can get the information from staff, and then make a decision. <br /> <br />Ms. Hosterman said that Mr. Brozosky's suggestion was acceptable. <br /> <br />Mr. Brozosky's motion died due to lack ora second. <br /> <br /> It was moved by Mayor Pico, seconded by Ms. Hosterman, to approve the <br />postponement of the payment of the in-lieu park dedication fees for this project <br />until January 2005, but allow the developer the opportunity to approach the <br />Planning and Parks and Recreation Commissions with its request for a modification <br />of the fees. <br /> <br /> Mr. Brozosky did not believe it was the Planning Commission's prerogative to <br />consider fees. In past conversations with members of the Planning Commission, he was <br />informed that the Commission does not concern itself with fees, but with the planning <br />portion of a project. <br /> <br /> Ms. Ayala believed that the minutes of the Parks and Recreation Commission <br />meetings would reflect that it wanted Council to make this decision. She said that she <br />would not be supporting this motion. <br /> <br />Mayor Pico withdrew his motion. <br /> <br /> It was moved by Mayor Pieo, seconded by Ms. Ayala, to postpone the <br />payment of the in-lieu park dedication fees unffi January 2005. <br /> <br /> If this motion passed, Ms. Hosterman asked if this action would still allow the <br />developer the opportunity to come back to Council and/or the Planning Commission <br />regarding a partial waiver of the fees? <br /> <br />Pleasanton City Council 15 05/04/04 <br />Minutes <br /> <br /> <br />
