agencies, as noted in the staff report, and to direct staff to work with local and <br />regional organizations including the Chamber of Commerce and any other group <br />that is interested, to promote and implement the City's legislative positions. <br /> <br /> Ms. Hosterman was concerned about getting into an area that would infringe on <br />workers' rights. She had issues related to getting involved in making determinations as <br />to whether or not individual workers can utilize doctors of his or her choice. She believed <br />everyone ought to be able to use his or her own doctor and change doctors as well. She <br />asked if recommendations three and four were related with the reforms as bulleted in the <br />staff report, or would Council be considering something different than that which is <br />stated in the conclusion to the staffreport, which states that "our State needs to find a <br />way to reduce or eliminate presumptive injuries, reform Labor Code 4850, legitimize the <br />workers compensation appeals board, and establish standards for medical providers." If <br />this is the language Council is considering engaging in and entering into with its <br />legislators, she could support that. If Council was going to discuss the bulleted measures, <br />she wanted them picked apart piece by piece. If Council was talking about the four main <br />bulleted areas loosely and entering into discussion about how future legislation might <br />tackle those areas in a way which would be beneficial not only for public agencies but for <br />employers and maintaining employee rights, that was one thing. However, if Council <br />wanted to talk about upsetting the "no-fault system" then she would like to have fu~er <br />discussion. <br /> <br /> Ms. Ayala asked the maker of the motion to eliminate the section entitled <br />"Establish Standards for Medical Providers" from the motion. <br /> <br /> Ms. Hosterman pointed out that she also referred to the section entitled "Reform <br />Presumptive Injuries." <br /> <br /> Ms. McKeehan suggested including the sentence staff drafted in the concluding <br />statement of the staff report in the motion as the first step. <br /> <br /> Ms. Hosterman offered a substitute motion that would include aH aspects of <br />Mr. Brozosky's motion, and narrow it to include the one sentence as mentioned in <br />the conclusion to the staff report. <br /> <br /> Mr. Brozosky appreciated the work that staffhad done and could not support the <br />substitute motion. <br /> <br /> Ms. Ayala pointed out that the recommendation is to communicate with the City's <br />legislators and the Governor to support additional workers' compensation reform for <br />public agencies. <br /> <br /> Ms. Hosterman stated again that she would need more information before she <br />could agree to make a recommendation and support reform for the Workers' <br />Compensation Appeals Board. <br /> <br />Pleasanton City Council 2 01/27/04 <br />Minutes <br /> <br /> <br />
