The roll call vote was as follows: <br />AYES: Councllmember Campbell and Mayor Pico <br />NOES: Councilmembers Ayala and Brozosky <br />ABSENT: None <br />ABSTAIN: Councilmember Hosterman <br /> <br />Mr. Brozosky asked legal staffto clarify what it meant when there was a tie vote. <br /> <br /> Mr. Roush said that the Planning Commission's decision would be upheld <br />because there was no motion to overturn its decision. The Planning Commission's <br />decision would stand unless there are three votes to do something different. <br /> <br /> Ms. Ayala said that staff's recommendation was deny the appeal but she wanted <br />to uphold the appeal of the Hatlcers and approve the project. <br /> <br /> Mr. Campbell said that he wanted to be sensitive to the Hafkers, but at the same <br />time, he believed there was a reason for Council codifying things. He would like for the <br />Hafkers to be able to get an additional lot, but believed Council needed to be consistent. <br /> <br /> Ms. Ayaia pointed out that Council did approve the Moriera development of four <br />lots instead of three lots. <br /> <br /> Mayor Pico indicated that the Moriera development was under a different set of <br />circumstances. <br /> <br /> It was moved by Mr. Brozosky, and seconded by Mr. Campbell, to deny the <br />Hafkers appeal but encourage the Hafkers to initiate a Specific Plan change in order <br />to obtain the extra lot. <br /> <br /> Mayor Pico indicated that Mr. Brozosky's motion was basically the same as his <br />previous motion. <br /> <br />Mr. Campbell believed Mr. Brozosky's motion was stronger. <br /> <br />The roll call vote was as follows: <br />AYES: Councilmembers - Brozosky, Campbell, and Mayor Pico <br />NOES: Councilmember Ayala <br />ABSENT: None <br />ABSTAIN: Councllmember Hosterman <br /> <br />6.__~c <br />Development Review Process for Kottinger Hills, PUD -33.
