He did not want the developer to be iven the 0pportuniW to have a ratio of <br />one to one and a half for for-sale affordable housing units. <br /> <br /> Ms. Ayala pointed out that the City is involved in a lawsuit on the matter, and <br />noted that the City's position has changed since the original approval of the project. <br /> <br /> Again, Mr. Pico pointed out that the issue of credits has no relationship to the <br />houses being built. <br /> <br /> A substitute motion was made by Mayor Pico and seconded by Mr. <br />Campbell, to authorize the issuance of the credits on a one-to-one basis for rental-to- <br />rental uses only on the Busch property. <br /> <br /> If the School Dislxict does not take the option on the 23-acre site, Ms. Ayala <br />asked if the underlying zoning would allow market rate senior housing? <br /> <br /> Mr. Brozosky pointed out that the 23-acre site had already been zoned and he <br />believed rental units could not be located on the property. <br /> <br /> Ms. Ayala indicated that she would like aa opportunity to vote on her motion. <br />Her desire was for Council to be given the opportunity to discuss with the developer the <br />changed circumstances, as Council was willing to discuss Ponderosa's changed <br />circumstances. <br /> <br />Mr. Brozosky asked for clarification to the substitute motion. <br /> <br /> Ms. McKeehan noted the developer could present a plan that could include senior <br />housing. The 23-acre site is not restricted to for sale housing. <br /> <br /> Mr. Swift reported that the only permitted use was senior housing, but there was <br />no limitation as to whether it had to be for sale housing or rental housing. He believed <br />the applicant indicated it would think about building a for sale senior housing project. <br /> <br /> Ms. Ayala believed there was a condition in the approval process. She pointed <br />out that staff and the Planning Commission recommended it be shown as a senior, <br />medium density, residential project, if not acquired by the Pleasanton Unified School <br />District. <br /> <br /> Mr. Swift concurred with Ms. Ayala's comments. He pointed out that the PUD <br />did not say rental or for sale.
