She meatiotted that there axe a fe~ families on <br />Happy Valley Road who are exl~-i~ncing a drop in thgir well water table. <br /> <br /> Jhn Happ, Northstar Construction and Development, 275 Rose Avenue, Suite <br />203, believed the Mr. Brozosky's concerns related to the offhaul of dirt are already <br />addressed in the PUD conditions and the City Engineer is to approve any offhanl plan. <br />There is a possibility that tracks will not be used and the dirt will either not go offthe <br />properties or go to adjoining properties. Conditions of the PUD require the retaining <br />wails. He mentioned the location ofa cliffthat runs as high as 11 to 12 feet down the <br />existing Vineyard Avenue. If the cliffis to stay, as in the originai plan, the retaining <br />walls will not be needed. As requested by staff, Northstar Construction and Development <br />will take the grade down to the road. <br /> <br /> With respect to the trucks offhauling dirt, Mayor Pico inquired as to whether staff <br />has discretion to impose reasonable requirements so that it does not interrupt school <br />~'affic. <br /> <br /> Mr. Swift informed him that the condition does give the City Engineer authority <br />over the haul route as with any other project. Language could be added that would ailow <br />the City Engineer to adjust the hours and routes for the offhanl of dirt. <br /> <br /> It was moved by Mr. Campbell, seconded by Ms. Ayala to adopt Resolution <br />03=105 reaffirming the Council's previous decision in this matter and upholding the <br />appeal, thereby, approving vesting Tentative Map for Tract 7399 with the added <br />condition that the City Engineer expressly has the authority to regulate the hours <br />and routes in the off hanllng of materials. <br /> <br /> Ms. Hosterman strongly expressed that this was not her favorite project and the <br />only reason she is going along with it was because it was a project that was previously <br />approved and has been worked on for a long time. It is also a part of the community <br />process in the Vineyard Corridor to reduce the number of homes from 700 plus to 189. <br />She did not want to do anything to jeopardize the building of Neai School. Again, she <br />expressed her strong dislike for the project but stated she would reluctantly support it. <br /> <br />The roll call vote was as follows: <br />AYES: Couneilmembers -Ayala, Campbell, Hosterman, and Mayor <br /> <br /> Pico <br />NOES: None <br />ABSENT: None <br />ABSTAIN: Couneilmember Brozosky <br /> <br />Item 6E <br />Poflcv Reeardin~, Payment of Fees as Consideration of Providinu Sewer and/or <br />Water Service Prior to ,Annexation.
