Mr. Swirl explained that the Bernal/Tawney Drive signal was a condition of approval for
the last project, a print shop, in Stanley Business Park. Mr. Auf der Maur owns other
businesses in Stanley Business Park and the signal was included in the fee schedule for
the local traffic fee. Mr. Auf der Maur is eligible for a credit against that traffic fee. The
signal cost was higher than what was required by the project, so an agreement was
entered into to allow Mr. Auf der Maur to apply the amount of money for the signal in
excess of what was required for the printing shop against whatever fee may be, if
approved, for a new project in the Stanley Business Park. There is no obligation for
Council to approve any new projects within Stanley Business Park.

Approved plans and specifications, reviewed bids and awarded a contract for Stanley
Boulevard Widening at Valley and Bemal Avenues, Project No. 995031, to Top Grade
Construction Incorporated for a low bid of $688,934; and authorized the Director of
Public Works to approve and execute contract change orders for a contingency amount
not to exceed $137,786 (20% of construction contract) for necessary related subject
project work. (SR 03:216)

Ms. Hosterman asked when this project would be completed and when would the
landscaping be completed? She asked if there were contributions toward this project
from owners of contiguous properties?

Mr. Wilson said construction is expected to start within the next two months and it along
with the landscaping is expected to be complete by the end of this year.

Mr. Swirl said the widening of Stanley was required as a result of growth throughout the
City, not just Stanley Business Park. However, the Business Park developers dedicated
the right of way for the widening at no cost to the City. The remainder of the project is
funded from the local traffic fee/capital improvement program. Mr. Swift explained that
staff had deferred the landscaping for McDonald's because it would have to have been
ripped out with this project. The City will install landscaping along the street, including
street trees, and McDonald's will then install its landscaping up to the sidewalk.

Mr. Brozosky felt that the existing McDonald's landscaping is poorly maintained and
asked staff to investigate that.

jo

Approved Contract Amendment No. 2 with Bellecci & Associates for a cost not to
exceed $29,215 to provide additional engineering services; and authorized the City
Manager to execute the contract amendment.
