Mr. Roush explained that the EIR indicated the design was to look at a seven story <br />structure, but if there was not adequate funding to build that, then BART does not have to build <br />it. If there is funding, then the five story structure is to be built with an adequate foundation to <br />support seven stories. <br /> <br />Mr. Campbell asked if the City had any control of whether the extra two stories are built. <br /> <br />Mr. Roush said no. This agreement memorializes what is set forth in the EIR. <br /> <br /> Mr. Swirl fmther clarified that the plan proposed by BART was for a five level structure. <br />However, in order to address concerns raised in the EIR, one of the mitigation measures <br />suggested in the EIR and accepted by BART was to look at building foundations strong enough <br />to add two more levels at a furore time. This agreement is to put that mitigation in agreement <br />form, to provide some comfort to the Stoneridge Shopping Center. The City can't force BART <br />to build two more stories. <br /> <br /> Mr. Campbell asked what would happen if this item were tabled until the Dublin Liaison <br />Committee has had a chance to meet? Is it true that if Council does not approve the agreement, <br />BART can go ahead and do whatever it wants? <br /> <br /> Ms. McKeehan said there are many other issues in this agreement. The bottom line is the <br />City's relationship with Stoneridge and trying to make Stoneridge comfortable that a BART <br />station at this site would not overly impact the shopping center. In addition, we are trying to <br />encourage BART to come through the City's process for review of the plan. Ultimately, BART <br />has the final decision on what is built on their property, with the exception of something like an <br />office building. Most discussions through the Liaison Committee were about the uses and how <br />tall the office building was to be.
