Mr. Wilson explained that the Happy Valley Specific Plan did contemplate that this <br />improvement would be accepted for temporary public access. The only concern is the length of <br />time it would be in place and when it would become an emergency vehicle access only. Staff is <br />following the Specific Plan. <br /> <br /> Ms. Ayala asked if the wording of the resolution could be strengthened. §he strongly <br />supported the bypass road and wanted to protect this neighborhood. She felt the residents had <br />valid concerns about what a future Council may do. <br /> <br /> Mr. Roush felt the better approach was to review the CC&Rs and strengthen the language <br />there. <br /> <br /> Ms. Hosterman believed resolutions were defensible in a court of law and she believed <br />that when Council voted to approve an item, resolutions had meaning. <br /> <br /> Mr. Roush reiterated staff would make certain the CC&Rs have sufficient language to <br />guarantee Council's intent. <br /> <br /> Mr. Brozosky referred to other emergency vehicle access roads where there is a sleeve in <br />the road for a pole to be inserted. He asked if this road could be built with that sleeve in place so <br />people would be aware a pole could be installed later? <br /> <br /> Ms. Ayala suggested a big sign be installed that indicates this is a temporary road. She <br />also wanted stronger language in the resolution. <br /> <br />Mr. Roush said the resolution and CC&Rs could certainly be modified. <br /> <br /> It was moved by Mr. Campbell, seconded by Ms. Hosterman, to adopt Resolution <br />No. 03-067, conditionally accepting for public access purposes an emergency vehicle access, <br />and to accept a public service easement, between the southern border of Tract 7372 and <br />Alisai Street/Happy Valley Road; and directing staff to install a sign indicating the access is <br />temporary and will be closed upon the construction of the bypass road and to install in the <br />access, a sleeve or other improvements to accommodate the eventual placement of bollards <br />or other barriers. <br /> <br />The roll call vote was as follows: <br />AYES: Councilmembers - Ayala, Brozosky, Campbell, Hosterman, and Mayor Pico <br />NOES: None <br />ABSENT: None <br />ABSTAIN: None <br /> <br /> Ms. Hosterman indicated she was committed to the golf course project, but understood <br />the concerns of the residents.
