Mr. MacDonald felt the staff had already done that by requiring completion of Phase I <br />before proceeding with Phase II. <br /> <br /> Ms. Ayala said that condition was already required and Mr. Duggan did not comply. She <br />wanted a definite timeline. <br /> <br /> Mr. MacDonald said the normal sanction is ifa project is not completed in a certain time, <br />the approval expires. The time frame on this project has been shortened to six months instead of <br />one year. He suggested shortening the time to four month for Phase I. <br /> <br /> Ms. Ayala asked what happens to Mr. Duggan if he does not complete Phase I in six <br />months? <br /> <br /> Ms. McKeehan said staffhas recommended the second phase approval expire if he does <br />not get the first phase completed. <br /> <br />Mr. MacDonald agreed with that so long as Mr. Duggan is given the full six months. <br /> <br /> Mr. Roush said the conditions are reasonable stringent and that is why he had not <br />prepared any others for the meeting. Currently Mr. Duggan has three months to finish the first <br />floor living space and the porch addition and then six months to do the garage and second floor <br />additions. He believed the conditions as written require completion of the first phase before <br />proceeding with the second phase. <br /> <br /> Mr. MacDonald felt that made sense. He said Mr. Duggan did not mind doing the project <br />in phases, but he needed both phases. <br /> <br /> Mr. Swirl explained that if a person takes out a building permit and for some reason does <br />not complete the project in a timely manner, the building permit can be extended for quite a long <br />time. <br /> <br /> Ms. Ayala wanted it clear that if Phase I is not completed, then approval for Phase II <br />lapses. <br /> <br /> Mr. Swirl read condition 8 which stated design approval for the garage and second floor <br />addition shall lapse six months from approval unless a building permit is issued for the first floor <br />living space and porch additions and construction has commenced and is diligently pursued to <br />completion. <br /> <br /> Council made it clear that the first phase must be completed within six months before <br />proceeding with the second phase. <br /> <br /> Mr. MacDonald reiterated there is a contractor ready to proceed and he agreed with that <br />requirement. <br /> <br />Pleasanton City Council 30 03/18/03 <br />Minutes <br /> <br /> <br />
