Another option is to increase density on the <br />flat portion to one unit per one acre in order to help finance the cost of the bypass road. <br /> <br /> Mr. Campbell how the Specific Plan is affected if a road alternative is chosen that is <br />different than what is in the Specific Plan? <br /> <br /> Mr. Rasmussen said it would require an amendment to the General Plan, the Happy <br />Valley Specific Plan, and the PUD zoning. <br /> <br /> Mayor Pico asked if Alternative 4 could remain totally within the Spotorno property <br />closer to Sycamore Road, or does that get into the hillside? <br /> <br /> Mr. Rasmussen said it is as close to the hill as it can be considering the location of <br />existing homes. In order to keep it on the Spotorno property, it would have to go behind the <br />Balch house, which is at a high elevation. <br /> <br /> Mayor Pico asked what happens if an alternative bypass road is selected, the Specific <br />Plan is amended and then it is not feasible to build the alternate road because property owners <br />are not cooperating and the City is unwilling to proceed with condemnation proceedings? <br /> <br />Mr. Rasmussen felt staff would have to continue to look for alternatives. <br /> <br /> Mayor Pico believed that even if the Specific Plan alternative is used but the Spotomo <br />family refuses to finance the road or to provide the access for it, the City would be in the same <br />position as if it had selected an alternative proposal for the route that may be more feasible or <br />environmentally sound. <br /> <br /> Mr. Rasmussen said the Specific Plan states "early construction of the bypass road is a <br />high priority.., temporary vehicle access to the golf course from Happy Valley loop will be <br />permitted until the bypass road can be completed." <br /> <br /> Mayor Pico felt if any of the alternatives were chosen it may not be possible to build until <br />all permits are acquired, which may take twenty years. He asked what the impact on the golf <br />course would be? <br /> <br /> Mr. Roush said part of the legal challenge is that LAFCo's reliance on the EIR would no <br />longer be valid because there is not a definitive time table in which to actually construct the <br />bypass road set forth in the Specific Plan. <br /> <br />Mayor Pico did not believe there was any option that would allow a definitive timetable. <br /> <br /> Mr. Roush said in any event, it would seem that some condenmation of property would <br />be necessary other than to use the existing loop road. <br /> <br /> Mayor Pico asked if the City had the power to condemn property not within its city <br />limits? <br /> <br />Pleasanton City Council 7 01/21/03 <br />Minutes <br /> <br /> <br />
