Michael O'Callaghan, 3425 Arbor Drive, commented on the need for community <br />involvement for design studies for the Civic Center and the possible relocation of Main <br />Street. <br /> <br />6. PUBLIC HEAR1NGS AND OTHER MATTERS <br /> <br />Item 6a <br />PAP-29 (PMS-09h Appellants: Frank & Barbara Berlogar <br />Appeal of the Planning Commission's denial of Frank and Barbara Berlogar's <br />application for a tentative parcel map that would allow the division of an existing <br />45.03 acre property, into two parcels (Parcel One~ 7.57 acres in areal Parcel Two~ <br />37.46 acres in area} in conformance with PUD-5. Zoning for the property is PUD- <br />LDR~ HR~ and OS (Planned Unit Development - Low Density Residential~ Hillside <br />Residential~ and Open Space) District. (SR 02:082) <br /> <br />Brian Swirl presented the staff report. <br /> <br />Mayor Pico opened the public hearing. <br /> <br /> Frank Berlogar discussed his estate planning process by setting up a family <br />limited partnership and the funding of assets owned by the family. His goal in separating <br />the two parcels is (1) to put the 7.57 acres into the family limited partnership and (2) to <br />simplify the ultimate change of title of the land to a future purchaser. The application <br />was consistent with the Specific Plan. He was not asking for any variation or exception <br /> <br /> Councilmember Ayala asked if Mr. Berlogar would have any problem of adding a <br />condition that would clarify that the Specific Plan financing issues go with the property. <br /> <br /> Mr. Berlogar said a deed restriction would be an undue intrusion because he has <br />only two years to get tentative map approval. If this does not take place within this time, <br />he would have a deed restriction that would no longer apply to the property. <br /> <br />Councilmember Ayala said this would be a condition of approval for the project. <br /> <br /> Mr. Berlogar commented by saying if that were the case, it would be entirely <br />acceptable. <br /> <br /> Councilmember Michelotti asked Mr. Roush if the financing and the fees were in <br />the documentation that would go with this project. <br /> <br /> Mr. Roush said this would be an express condition of the PUD that would set <br />forth what the obligations are in terms of when the fees would be paid. It is contained <br />within the documents.
