4. CON§ENT CALENBAR <br /> <br /> It was moved by Ms. Michelotti, seconded by Mr. Campbell, that the following <br />actions be taken: <br /> <br />a. Approved the City Council Minutes for 02/19/02. <br /> <br />Robert Cordtz, 262 West Angela, referred to page 3 of the Minutes and indicated he <br />agreed with Mr. Dove in questioning the abstentions of Ms. Michelotti and Mayor Pico. <br />He also asked how the abstaining Councilmembers can "exert influence" on the <br />remaining Councilmembers. <br /> <br />Ms. Michelotti indicated that statement was corrected later in the meeting and that she <br />and Mayor Pico could not lobby or discuss this item with other Councilmembers. <br /> <br />Ms. Ayala indicated she welcomed the opinion of anyone on any subject. However, she <br />realized that it was made clear that Ms. Michelotti and Mayor Pico could not talk to her <br />about this issue. <br /> <br />Mr. Cordtz referred to the statement of the City Attorney that Ms. Michelotti and Mayor <br />Pico could address Council as property owners and inquired how that was possible since <br />they have a conflict of interests. <br /> <br />Mr. Roush indicated that a person, as a property owner, has a right to address a City <br />Council. Historically, councilmembers with conflicts have chosen not to do that, even <br />though they could legally. <br /> <br />Mr. Cordtz asked if the State law could be overruled? <br /> <br />Mr. Roush indicated that if there is a conflict of interest, a Councilmember may not <br />participate in the decision making process. That is the final word. <br /> <br />Actions of the Zoning Administrator and Planning Commission.
