charge property owners special assessments against their property for services that are <br />offered there. In this situation with the Oak Tree Farm subdivision, when it was <br />established the original developer agreed to the establishment of the GHAD. As a result, <br />on an annual basis the Council approves an assessment that is charged against each of the <br />properties that pays for the annual monitoring of the storm drains to make sure the storm <br />water is appropriately treated and in the event of a slide, it is taken care of. Under <br />Proposition 218 there is the right of the property owners, if they chose to act as a <br />majority, to request that the Council rescind the assessments that take place against the <br />property. However, in this situation, most of the property owners understand why the <br />GHAD is present and because of the size of the homes and the number of subdivisions, it <br />certainly makes sense fi.om an administrative standpoint to have the City work to <br />administer the maintenance of these various facilities, rather than have that burden placed <br />on individual property owners. In addition, because there is some open space and open <br />space corridors here, as well as City owned lot where the pump station is located, we also <br />contribute to the GHAD as our fair share. Technically there is the legal right for these <br />property owners to take an action to rescind the assessment, which is probably an <br />unlikely situation. Proposition 218 has been in effect for several years and the City has <br />heard of no interest from any property owners to have that kind of action taken. <br /> <br /> It was moved by Mr. Campbell, seconded by Ms. Ayala, to (1) adopt <br />Resolution No. 01:090 Certifying the Final Supplemental Environmental Impact <br />Report for Oak Tree Farm - Phase 3 (Including Adoption of New Regulations <br />Regarding Geotechulcai Setback Line); and (2) adopt Resolution No. 01:091 <br />Approving the Repeal of the Existing Prohibitions Regarding the Geotechulcal <br />Setback Line at Oak Tree Farm and the Adoption of New Regulations Regarding <br />Mitigation for the Area. <br /> <br /> Mayor Pict stated that he was abstaining because he has just returned fi.om a trade <br />mission to China, and has not had the opportunity to review the extensive technical <br />information. <br /> <br />The roll call vote was as follows: <br />AYES: Councilmembers -Ayala, Campbell, Dennis, Michelotti <br />NOES: None <br />ABSENT: None <br />ABSTAIN: Mayor Pict <br /> <br />Item 6c <br />PAP-22 (PSDR-76), Mardel LLC), <br />Appellant: Lynn Ann Sorensen <br />Appeal of the Planning Commission's approval of an application to install two <br />subdivision monument signs which state "Lemoine Ranch Estates" to be located at <br />4456 Foothill Road.
