She <br />believed Council should take cure of the entire community and be more careful in <br />considering the impacts on the community from further development. <br /> <br />There were no further speakers. <br /> <br /> Ms. Ayala asked in what ureas additional security could be required to give a <br />greater comfort level to Council that they will be performed. <br /> <br /> There was discussion about whether to include additional security for the winery, <br />traffic improvements, and certain mitigation items. <br /> <br />Ms. Dennis asked if there was a necessity for a contingency? <br /> <br /> Mr. Lum indicated when staff developed estimates for the intersection <br />improvements, contingencies were 'added above the normal requirement. So there is a <br />20% contingency for completion of improvements. However, there are no guarantees the <br />improvements will stay within the estimates. The rationale for accepting cash now is that <br />there is an agreement to use the money for other improvements if the desiguated <br />improvements are not built. In addifion the City' has the cash in hand and does not have <br />to try and get the money from a developer in the future when the improvements are <br />actually constructed. The right turn pocket on First Street/Vineyurd will probably not be <br />done. The Vineyard to Tawny widening is uncertain, definitely not in the neur future. <br /> <br /> Mayor Tarver felt the reason for a deferred improvement agreement was that the <br />developer was not happy with stafl~s estimates. <br /> <br /> Mr. Lum said there had been some recent changes in design based on field <br />observations that has raised issues not included in the earlier estimates. That would raise <br />the costs of the project and Signature has asked for the deferred improvement agreement <br />until those issues can be resolved. <br /> <br /> Mr. Pico relbrred to the estimate of $1.66 million for the Vineyard roadway <br />improvements. If the Vineyard roadway improvements were excluded, since they would <br />be covered by the deferred improvement agreement, what is the total amount of cash or <br />bonds for all the remaining mitigations? <br /> <br /> Ms. Seto said that based on the credit due to Signature Properties from its work on <br />the Vineyard "S' curve, balanced against the outstanding traffic mitigations, it is nearly a <br />wash in terms of cost.
