Ms. Michelotti said the time to comply with the shortfall is not until June 2001. <br /> <br /> Mayor Tarver felt the re,on the school fee agreement was modified was because <br />there was the fear that the shortfall would not be funded. <br /> <br /> Ms Michelotti disagreed. She felt it was because some developers were not <br />included and some facilities were not included in the original agreement. <br /> <br /> Ms. Detmis asked if the agreement with the School District was a separate issue <br />from the final map approval? <br /> <br /> Mr. Roush said it was tied in the sense that both the County PUD conditions and <br />the amended prearmexation agreement require the developer to pay school impact fees. <br />In order to get the final map approved, those conditions have to be satisfied. <br /> <br /> Ms. Dennis said the school impact fee agreement is a separate agreement and <br />asked if it is enforceable on its own, without regard to the final map? <br /> <br />Mr. Roush said yes. <br /> <br /> Mayor Tarver asked what was the process for taking care of the Vineyard Avenue <br />"S" curve and was it done in a timely fashion. <br /> <br /> Mr. Roush said there was an agreement between the City and Signature Properties <br />that the road would be improved within two years and it was constructed. There was <br />some disagreement about its timeliness. <br /> <br />Mayor Tarver commented it is not easy to get a surety company to perform. <br /> <br /> Mr. Roush said it is often difficult to get surety companies to perfom~ when they <br />don't think there is a breach of contract. <br /> <br /> Mayor Tarver asked if the City offered an incentive to get the "S" curve <br />straightened as it rotates to the rest of the Vineyard Corridor. <br /> <br />Mr. Roush said yes. It was tied to the adoption of the Specific Plan for the area. <br /> <br />Mayor Tarver invited public testimony. <br /> <br /> Linda Adorns, 159 Ray Street, indicated it was her understanding that the <br />developers were to take care of infrastructure before they were allowed to build, Now <br />there are 850 houses and no sehool. 'lhe street problems were not taken care of until after <br />the houses were constructed. The water problems have not been take care of and the <br />habitat problem was not recognized until later. This is occurring in areas other than Ruby <br />Hill.
