She was sorry Mayor Tarver felt <br />as he does. She believed there had never been a more cooperative relationship between <br />the two entities than now. <br /> <br />Item 6a( 1 ) <br />Approval of final map, improvement plans and Subdivision Agreement for Tract <br />7158, Ruby Hill, Ruby Hill Development Joint Venture, L.P.; audit of all conditions <br />of approval and agreements for project; acceptance of cash guaranties and <br />performance bonds for outstanding mitigation conditions. (SR00:215) <br /> <br />Item 6a(2) <br />Approval of reimbursement agreements with the Ruby Hill Development Joint <br />Venture for the Vineyard "S' Curve Sewer Extension and the Ruby Hill Emergency <br />Fire Facilily. (SR00:214) <br /> <br />Randy Lum and Larissa Scto presented the staffreports. <br /> <br /> Mayor Tarvet asked if there were an obligation to enter into reimbursement <br />agreements. <br /> <br /> Mr. Roush indicated that under the Government Code and Subdivision Map Act, <br />if a developer constructs public improvements which benefit more than just the <br />dcveloper's project, then there is a statutory obligation to allow the developer to recover <br />those costs from other property owners who benefit. That is why the reimbursement <br />agreements are proposed for the fire station and sewer extension. <br /> <br />Mayor Tarver asked if that were true for school facilities as well? <br /> <br />Mr. Roush did not think school facilities are covered by those statutes. <br /> <br /> Mr. Pico asked if the Development Agreement would take precedence over the <br />reimbursement agreements. <br /> <br /> Mr. Roush said it would, but nothing precludes the City from entering into these <br />types of reimbursement agreements. <br /> <br />Ms. Michelotti asked who provides sewer treatment for Ruby Hill. <br /> <br />Pleasanton City Council 10 10/03/00 <br />Minutes <br /> <br /> <br />
