Mr. Roush replied that Greenbriar would proceed in good faith to obtain permits. <br />The City staff will insure it is a dedicated effort for Greenbriar to do it within 24 months. <br />He did not believe Greenbriar would be idle in that time. <br /> <br /> Mayor Tarver wanted assurance that Greenbriar would pursue the permits with <br />due diligence for Alternative A. <br /> <br /> Mr. Costanzo volunteered to provide copies of all correspondence to show the <br />City it was actively pursuing the permits or could provide monthly status reports. <br /> <br />Ms. Dennis wanted Council to be aware that Alternative B was a real alternative. <br /> <br /> Mr. Pico pointed out Alternative B would not be approved until after 24 months <br />and wanted assurance that Greenbriar would diligently pursue Alternative A and if there <br />are any problems, then Council will be aware of it and take necessary remedies. <br /> <br /> Mr. Costanzo indicated Greenbriar has every reason to pursue that Alternative and <br />felt the existing conditions covered that, but would gladly add a provisions to provide <br />monthly reporting. <br /> <br /> Mr. Roush asserted that if staff felt Greenbriar was not pursuing the application, <br />Article 5 says it can provide notice of breach of contract. That is the legal remedy <br />Council would have. <br /> <br /> Mr. Costanzo reminded Council it has the ultimate approval of the maps and <br />reiterated his belief that Greenbriar would have its permits in one year. <br /> <br />Mr. Pico asked if processing Alternative B could wait twelve months. <br /> <br /> Mr. Costanzo indicated the master teutative map should have both altematives <br />and he didn't understand the concern. Council has control of approval of final maps and <br />he only wanted to have an alternative in place. <br /> <br /> Mr. Roush suggested that tentative map conditions could be written in such a way <br />as to protect Council's concerns at the final map stage. <br /> <br /> Mr. Pico asked ifa condition could be written to say that before the final map for <br />Alternative B could be approved that due diligence would have to be demonstrated <br />regarding the processing of Alternative A. <br /> <br /> Mr. Roush said it is stated at the expiration of 24 mouths or when the City and <br />Greenbriar agreed that the permit could not be obtained [within the 24 months]. <br /> <br /> Mayor Tarver asked about the guaramee of sewer capacity and ho~v it would be <br />provided. <br /> <br />Pleasanton City Council 16 08/21/00 <br />Minutes <br /> <br /> <br />
