Mayor Tarver said he would not oppose the motion, but he had concems about the end of this process. In the same way he encouraged the Happy Valley owners to annex, he encouraged the Remen Tract, because it is better to do it earlier than later. It will cost the Happy Valley area ten times as much today as it would have years ago. That will happen to the people in this area too. A plan needs to be developed for this area and the sooner the better. He asked these property owners to talk to their neighbors. MATTERS INITIATED BY COUNCIL Ms. Dennis indicated she had received a question from Lois Lutz, Chair of the South Livermore Valley Land Trust, regarding the status of the Army Corps of Engineers permit for Signature Properties. She also had a question about including the Foley Pond in the habitat easement. Mr. Roush indicated there have been a number of staff meetings regarding the Ruby Hill conditions of approval and discussions with the property developer regarding the permit and pond. A report will come back to Council in the next month or so. Ms. Ayala referred to the MTBE report on "Sixty Minutes" and asked for an update. Mayor Tarver said "Sixty Minutes" lacked current information. The MTBE issue has been acted upon by the Governor. Ms. Acosta said a staff report was being ~nalized at this time and would be before Council shortly. Ms. Ayala suggested cooperation with surrounding cities to send a resolution to Governor Davis asking that the MTBE removal be done sooner than the established two year deadline.
