what the liability to the City would be if there was an accident and a child was hurt. She then <br />reviewed the conditions of the permit and indicated the violations. Mrs. Cence referred to the <br />map and indicated the people in support do not live in an area affected by the problems created <br />by Mrs. Lew's business. <br /> <br /> Mrs. Cence referred to Ms. Lew's letter which stated "who your neighbors are should <br />not be the determining factor for City policies." She cited the Pleasanton Municipal Code which <br />states a home occupation cannot create the potential for changing the residential character of the <br />neighborhood. She referred to Ms. Lew's allegation of being the victim of discrimination and <br />harassment and she asked by whom? Not the Planning Commission, which granted her <br />application despite previous violations. Her neighbors have been patient and cooperative for 21 <br />years. The neighbors have not appealed; Ms. Lew has. The neighbors ask only that she comply <br />with the conditions of the permits and the rights of the neighbors be observed. She urged <br />Council to limit students to 32 and to prohibit lessons on Friday. She asked also asked that the <br />conditions regarding parking in the driveway and requiring the garage to be cleaned out be <br />maintained. Mrs. Cence stated Mrs. Lew has two cars and cited problems with Mrs. Lew <br />parking her antique car on the street without moving it. If Mrs. Lew's son gets a car or the <br />brothers return with their cars, there will then be major parking problems without the garage. <br />Mrs. Cence suggested that Mrs. Lew move her business to a commercial location. <br /> <br /> Margo Kelly, 5157 Independence Drive, was here to express her views on the traffic <br />light on Main Street, but could not wait any longer. She supported any woman who wants to <br />stay home to be with her children and operate a business in the home. She objected to the <br />attitude of the Code Enforcement Officer with regard to boutiques. She felt the City regulations <br />for home occupation are too strict and indicated her business had been closed because of the <br />complaint of one neighbor. She cited major companies that had been started in the home. <br /> <br /> Jim Cence, 2142 Camino Brazos, objected strongly to the allegation about Cambodian <br />gangs and demanded an apology. The basic issues are: 1) operating a business in the <br />neighborhood is disruptive to the character and harmony of the neighborhood; 2) a history of <br />non-compliance with conditions by Mrs. Lew. He cited past problems with parking and Mrs. <br />Lew's inability to enforce the conditions. He also stated that Mrs. Lew said she was going to <br />close her business and has not done that. He referred to the allegation of harassment and <br />believes that the neighbors are the ones who have been harassed. He strongly urged Council <br />to prohibit lessons on Friday, to limit the number of students, and adhere to the conditions set <br />by the Planning Commission. Mr. Cence asked Council to look at the situation from the eyes <br />of the neighbors and impose reasonable conditions. <br /> <br /> Peter MacDonald reiterated the desire to have standard rules for all piano teachers to <br />avoid these neighborhood squabbles. He indicated that one neighbor did indeed make a <br />reference to Cambodian gangs. Regarding the statement that Ms. Lew said she would close her <br />business, when Ms. Lew returned from San Diego she discovered the problems arising from <br />teachers using her home and she did close that part of her business.
