Ms. Dennis suggested keeping the same number of students but lengthening the hours to <br />allow for make-up lessons. Pan of a home occupation ~s being able to fit with the <br />neighborhood. Due to the success of the business, perhaps the applicant could go out of the <br />home for addition teaching for the remainder of the week. <br /> <br /> Ms. Mohr believed limiting the students required voluntary compliance by the applicant <br />and would present enforcement problems. She preferred regulation of the number of hours and <br />making sure the students were one on one. <br /> <br /> It was moved by Ms. Mohr to establish conditions that the resident teacher can teach one <br />student at a time and no non-resident instructors can be there; the hours would be 12:00 p.m. <br />to 7:00 p.m. Monday through Thursday, 12:00 p.m. to 6:00 p.m. on Friday, 12:00 p.m. to 4:00 <br />p.m. on Saturday; that there be no amplified instruments; no garage use for teaching; no sale <br />of associated merchandise from the home; that off-site noise not be allowed; no signs; the <br />windows shall remain closed; and no recitals on site. <br /> <br />The motion died for lack of a second. <br /> <br /> It was moved by Ms. Dennis, seconded by Mr. Pico, to approve the staff <br />recommendation but limiting instruction to four days a week and expanding the hours from <br />10:00 a.m. to 7:00 p.m. Monday through Thursday. <br /> <br /> Mr. Tarver felt expanding the hours to allow flexibility for make-up lessons is <br />appropriate and believed that if there are violations the matter can come back to Council. He <br />understands the need for Mrs. Lew to make a living. He would hope that the issues would go <br />away if the conditions are followed and there is respect for the neighborhood. <br /> <br /> Mr. Tarver proposed a substitute motion, seconded by Ms. Mohr, to alter the proposed <br />condition l(c) to have ten students per day. <br />The vote on the whether to accept the substitute motion was as follows: <br />AYES: Councilmembers - Mohr and Mayor Tarvet <br />NOES: Councilmembers - Dennis and Pico <br />ABSENT: Councilmember Scribner <br />ABSTAIN: None <br /> <br /> Due to the tie vote, the motion to accept the substitute motion failed and Council returned <br />to deliberation on the original motion of Ms. Dennis to approve the proposed conditions of <br />approval modifying condition l(a) for hours of operation Monday - Thursday, 10:00 a.m. to <br />7:00 p.m. and changing l(c) to "the total number of students shall be limited to a maximum of <br />ten per day." All other conditions apply. <br /> <br /> Mr. MacDonald stressed the need to allow students to be at Mrs. Lew's house until 8:00 <br />p.m. at least two nights a week. <br /> <br />10/18/94 <br /> - 11 - <br /> <br /> <br />
