Mr. Tarvet agked if the applicant would accept conditions that could potentially close its <br />business and if that occurred, the site would need to be restored. <br /> <br /> Mr. Hirst indicated the applicant is prepared to meet any reasonable requirements. He <br />assured Council that if the business were to be closed the building would be removed and <br />landscaping would be restored <br /> <br />There being no further testimony, the public hearing was closed. <br /> <br /> Ms. Mohr expressed her desire to have more landscape around the business and <br />additional landscaping at the entrance to the shopping center from Santa Rita. <br /> <br /> Ms. Dennis inquired how the conditions could be mended to solve traffic problems. <br />Mr. Swift referred to condition 4 and suggested addition of problems at entrances or driveways <br />and effects on the Santa Rita/Pimlico traffic signal. He agreed there would be few added vehicle <br />trips, however, traffic movement in the form of lane changes could be affected. <br /> <br /> Mr. Pico agreed there is a need for this type of business but was concerned about traffic <br />and modifying Measure X. He did not feel there was sufficient reason to override the decision <br />of the Planning Commission. <br /> <br /> It was moved by Mr. Pico to deny the major modification. The motion died for lack of <br />a second. <br /> <br /> Mr. Tarvet indicated this whole center has been a problem for many different reasons. <br />He indicated there has been a number of conditional use applications which were strongly <br />opposed by people. After the businesses had been in operation, the worst fears did not <br />materialiTe and with one exception, there have been no problems. He indicated his belief that <br />the operators of this business will not let the facility be a detriment to the center or the <br />community. There is a major commitment by this applicant and he believed it should be given <br />a chance. <br /> <br /> Ms. Dennis also had misgivings, but after discussions with citizens, most people were <br />were in support and Ms. Dennis believed the risk was on the applicant and it should be given <br />an opportunity. <br /> <br /> It was moved by Ms. Scribner, seconded by Ms. Mohr, that Ordinance No. 1639 be <br />introduced, to be read by title only and waiving further reading thereof, approv'mg <br />PUD-80-15-SD4M, the major modification of the Measure "X* development plan, to <br />conditionally allow this drive-through, take-out use in the Pk'~nt Village Shopping Center. <br /> <br />09/20/94 <br /> -6- <br /> <br /> <br />
