Ms. Mohr clarified that action needs to be taken with regard to the Octman property
regardless and that any action affecting the Graham property would come back before Council.
She felt uncomfortable discussing the Graham property until further information is provided.

There being no further testimony, the public hearing was closed.

It was moved by Ms. Mohr to approve the staff recommendation. The motion died for
lack of a second.

Mr. Tarver felt that if the plan were clear, it would be appropriate to proceed with the
eminent domain action, but it was not clear how much property was necessary or what the
appropriate alignment would be. He reiterated the importance of having the "S ' curve improved
before Ruby Hill homes are occupied, but that does not appear to be possible now. Mr. Tarvet
preferred that the road move north and lower it to satisfy concerns of Mr. Graham and Mx.
Octman and try to avoid eminent domain proceedings.

It was moved by Ms. Scribner, seconded by Ms. Dennis, to table this item pending
receipt of further information.
The roll call vote was as follows:
AYES: Councilmembers - Dennis, Mohr, Pico, Scribner, and Mayor Tarvet
NOES: None
ABSENT: None
ABSTAIN: None

Mayor Tarver thanked staff and Signature for trying to accomplish the straightening of
the "S" curve as soon as possible, but it seems that it will take longer than expected.

8. MATFER INITIATED BY COUNCIL

Item 8a
Four-way Stol)/Traffic Signal at Main Street and Rose Avenue/Meal Street (SR 94:301)

Randall Lure presented the staff report.

Mr. Tarver asked why both sWp signs and flashing red light are necessary.

Mr. van Gelder responded that it was not necessary to have both, but staff felt it was
important.

Shafteli Michelotti, 7873 Olive Court, commended the idea of slowing traffic for the
downtown, but at this location it is causing much frustration. She agreed with the staff
recommendation to activate the traffic signal.

09/20/94
- 12-
