REPORTS OF THE CITY ATTORNEY <br />Report Re: City Council Resolution No. 70-25 <C-N Zoning for...Macka7 Homes} <br /> Mr. Hirst reported that the Planning Commission, at it's meeting of March 25, <br />1970, had instructed him to communicate to the City Council their feelings with <br />regard to the C-N Zoning for Mackay Homes. <br /> He stated that his findings are as follows: <br /> 1. That the parcel proposed for C-N zoning, being approximately 8 gross <br /> acres and 6.5 net acres, is appropriately sized and that C-N zoning <br /> be established for said parcel or applied for and as recommended by the <br /> Planning Commission on January 14, 1970, by Resolution No. 477. <br /> 2. That making final zoning dependent upon proof of acquisition by <br /> applicant of an "anchor tenant" is not necessary. <br /> <br /> After considerable discussion regarding this matter, it was moved by Councilma~ <br />Reid and seconded by Councilman Rega that a public hearing be scheduled for April <br />13, 1970, in order to re-consider the subject zoning. <br />The roll call_vote was as foilows: <br />AYES: Councilmen Rega, Reid, Splliotopoulos and Mayor Getton <br />NOES: None <br />ABSENT: Councilman Beratlis <br /> <br />COMbflJNI eATIONS <br />From Mr. John ~maral, Secretary-Manager; Ple~santon Chamber of Commerce Re: <br />~pposition to the Proposed Density Moratorium <br /> Mr. Fales read the letter from the Chamber of Commerce which stated that it's <br />Board of Directors, at their monthly meeting on March 11, 1970, adopted the <br />following motion: <br /> "Moved, that we support the General Master Plan <br /> as is, and also support the City Council on <br /> Urban Development Density question, and oppose <br /> any moratorium." <br /> <br /> The letter from the Chamber of Commerce also disclosed the fact that there <br />were three dissenting votes, seven in favor with one abstaining. <br /> Mayor Gerton asked Mr. Fales to supply him with the names of the three <br />directors who dissented. <br /> <br />MATTERS INITIATED_BY COUNCIL MEMBERS <br /> There were no matters initiated for discussion by the members of the City <br />Council. <br /> <br />F~ZETING OPEN TO THE PUBLIC <br /> No one addressed the Chair. <br /> <br />ADJOURNMENT <br /> There being no further business at 9:50 P.M., it was moved by Councilman Reid <br />and seconded by Councilman Rega that the meeting be adjourned to meet again in <br />Adjourned Regular Session at 8:00 P.M., on April 6, 1970. <br />The roll call vote was as follows= <br />AYES: Councilmen Rega, Reid, Spiliotopoulos and Mayor Getton <br />NOES: None <br />ABSENT: Councilman Beratlis <br /> <br /> Respectfully submitted, <br /> <br /> HELEN C.
