k. Scheduling a public hearing on the application of the Planning Commission to <br /> amend Section 13.112 and Section 13.113 of Ordinance No. 520, so as to require <br /> that public hearings be required by both the Planning Commission and the City <br /> Council in their consideration of Planned Unit Development Tentative Develop- <br /> ment Plans, for March 23, 1970. <br /> <br /> 1. Adoption of Resolution No. 70-46, consolidating precincts, designating polling <br /> places, appointing election officers and fixing compensation thereof. <br /> <br /> The roll call vote was as follows: <br /> AYES: Councilmen Beratlis, Rega, Reid, Spiliotopoulos and Mayor Gerton <br /> NOES: None <br /> ABSENT: None <br /> <br /> Councilman Rega stated that item 4-i, which was listed on the Consent Calendar, <br /> regarding the approval of a time extension for a Preliminary P.U.D. approval, for <br /> Morrison Homes Apartment Complex at Black Avenue and Hopyard Road, was a contro- <br /> versial item which related to density and should be referred to the General Plan <br /> Review Committee. <br /> Councilman Reid indicated that this item only requested a one year time ex- <br /> tension and emphasized that this request for a time extension did not fall within <br /> the charges given to the General Plan Review Committee. <br /> Councilman Beratlis concurred with Councilman Reid. <br /> After some discussion, it was moved by Councilman Rega and seconded by Council- <br /> man Reid that the request for a time extension on the Preliminary PUD Approval for <br /> the Morrl~on Homes Apartment Complex be referred to the General Plan Review Com- <br /> mittee for consideration. <br /> The roll call vote was as follows: <br /> AYES: Councilman Rega <br /> NOES: Councilmen Beratlis, Reid, Spiliotopoulos and Mayor Getton <br /> ABSENT: None <br /> <br /> It was moved by Councilman Beratlis and seconded by Councilman Reid that <br /> Resolution No. 70-47, granting a one-year time extension on the Preliminary PUD <br /> Approval for the Morrison Homes Apartment Complex at Black Avenue and Hopyard Road, <br /> be adopted. <br /> The roll call vote was as follows: <br /> AYES: Councilmen Beratlis, Reid, Spiliotopoulos and Mayor Gerton <br /> NOES: Councilman Rega <br /> ABSENT: None <br /> <br /> Councilman Rega stated that he still believed that any matter regarding high <br /> density should be referred to the General Plan Review Committee. <br /> <br /> Councilman Beratlis reported that he had received a request for the Mayor to <br /> proclaim March 15-22, 1970, as International DeMolay Week. <br /> It was moved by Councilman Beratlis and seconded by Councilman Reid that the <br /> Mayor be authorized to proclaim the week of March 15th-22nd, 1970, as International <br /> DeMOlay Week. <br /> The roll call vote was as follows: <br /> AYES: Councilmen Beratlis, Rega, Reid, Spiliotopoulos and Mayor Gerton <br /> NOES: None <br /> ABSENT: None <br /> <br /> PUBLIC HEARINGS <br /> Appeal of Mr. Iterman D. Ruth, 2150 Dwi.ght Way~ Berkeley, 9n behalf of Mr. Phil <br />" D~Vtdson, from an adverse decision of the Plannin~ Commission in denying aq <br /> application to fezone.from the R-1-6500.(Single-Family} District to the P.U.D. <br /> (Planned Unit Development} District~ that property described as Parcel 1, Assessor's <br /> Map Book 94~, BlOck 3032~ located immediately east of Sunol Bl~d.~ and frontin~ on <br /> Arlington. Drive, said property containing approximately 3.13 gr~ss acres <br /> Mr. Castro reviewed his report, dated February 23, 1970, in which he had com- <br /> puted the density for this lot and found that the applicant, in his current pro- <br /> posal is five units over the allowable density of 19.54 units and recommended that <br /> ~he application be denied. <br /> Mayor Gerton declared the public hearing open. <br /> Mr. Herman Ruth, on behalf of Mr. Phil Davidson, displayed drawings of the <br /> proposed apartment complex and reviewed the history of this entire matter. Mr. <br /> Ruth requested the Council to find that this application is in conformity with <br /> the General Plan and approve this rezoning. <br /> <br /> <br />
