PUBLIC HEARINGS <br /> <br />Application of Besco, Inc~ for final developme.nt plan approval of <br />RZ-70-7 (PUD), a townhouse development proposed to be located on the <br />west side of Santa Rita Road north of the Arroyo Mocho Canal, Tract <br />No. 3232, containing approximately 23.8 acres. <br /> <br />Report of the Planning. Commission Re: Review of Park Dedication Rec~uire- <br />ments; Tentative Subdivision ~ap, Tract No. 3232, Besco, Inc. <br /> <br />Mr. Fales requested that the above items be discussed simultaneously <br />because of their relationship to each other. <br /> <br />Mayor Reid asked the City Attorney to advise the Council what action <br />they can take relative to the request of Besco regarding the park <br />dedication requirements. Mr. IIirst replied that the Council cannot <br />grant a credit for park dedication improvements on their Las Positas <br />development ~ithin Tract No~ 3232. <br /> <br />Mayor Reid declared the public hearing open. <br /> <br />Mr. Aiello reviewed his report, dated February. 11, 1971, in which he <br />stated that the only question of concern involved the landscaping. <br />He reported that Besco noted all the trees on the landscaping plan as <br />a 5 gallon size and the staff recommended a 15 gallon size. Mr. <br />Aiello reported that the other item of concern regarding the turn- <br />around radius for the fire truck had been worked out between McKay <br /> & Somps and the Fire Department. <br /> <br />Mr. Jim Belda, representing Singer Housing Company and former~ly~Besco <br />Builders, inc. requested consideration regarding the 15 gallon tree <br />size requirement. Mr. Belda stated that the larger trees would cost <br />an additional $9,800 which would reflect a $75.00 per unit increase. <br />Mr. Belda also stated that he felt that $200 per unit in park fees <br />were extremely high. Mr. Belda reminded the Council that he had <br />promised to develop homes for lower income families and in order to <br />keep the cost of these homes at a minimum price, he would agree to <br />plant the 15 gallon s].ze trees if the Council would grant a credit <br />of $75.00 per unit against the park dedication fee. <br /> <br />Mayor Reid stated that the City Council could not grant this request. <br />Mr. Hirst reiterated the fact that this development does not meet the <br />requirement as noted in Resolution No. 68-192 to qualify for fee <br />credit. <br /> <br /> Considerable discussion ensued regarding the 15 gallon size trees. <br /> <br />There being no public protest, it was moved by Councilman Beratlis <br />and seconded by Councilman Spiliotopoulos that the public hearing be <br />closed. <br /> <br />The roll call vote was as follows: <br /> <br />AYES: Councilmen Beratlis, Spiliotopoulos and Mayor Reid <br />NOF~q: None <br />ABSENT: Councilmen Gerton and Pearson <br /> <br />Mr. Fales stated that he is receipt of a letter from Mr. Belda, dated <br />March 12, 1971, which indicates that the park dedication fees required <br />under Ordinance No. 439, for this tract, in the amount of $26,000.00 <br />has been paid under protest. Mr. Fales further stated that the <br />decision of the Supreme Court will effect the City's disposition of <br />t~is money. <br /> <br /> 2. 3-39-71 <br /> <br /> <br />
