PUBLIC HEARINGS <br /> <br />.Appeal of the Osmendsen Com. pa.ny, from an adverse decislon of the Planning <br />Commission in denying Variences to all0{4 the r~ garage set- <br />· acks as follows: <br /> <br /> 1. V-72-1, Lot 4, Tract 2659t Rosepoint Subdivision~ 421 Arlington Ct. <br /> - reduce gargae setback from 20' to 16'; <br /> <br /> 2. V-72-2, Lot 13, Tract 2659, Rosepoint Subdivision., 568 H~milton <br /> Way '___reduce garage setback 'from 20' to 17'; <br /> <br /> V-72-3, Lot 17, Tract 2659,. Rosepoint SubdivZsion, 6479 Randall <br /> Court - reduce .garage <br /> <br />Mayor Reid declared the public hearing open and asked~ foz' a.Staff <br />report. <br /> <br />Mr. Edgar explained that the subject three single family building permits <br />were applied for.and granted. In each there is .a ~iolation of front <br />yard set back requirements in that the garages were 16,-t7.and 18 feet <br />from the front property li~e curb rather than the 20 feet as required <br />by the Zoning Ordinance. <br /> <br />Mr. Aiello presented drawings and elaborated on the errors. He stated <br />that a possible solution for lot 17 would be to have a roll-up door <br />installed. rather than a swing-u~ door~ but felt there were. no visable <br />solutions as to the specific driveways in lots 4 and 13. He offered <br />the possibility that the present garage on Lot 13 be remodeled to be <br />incorporated into the ~.iving area of the house and that an unattached <br />garage be constructed to the rear of the lot as ther. e was!-. sufficient <br />accessibility thEough the sideyard. <br /> <br />Mr. James Ring, attorney for the Osmundsen Company, stated that the <br />error was a unilateral mistake and that the conracto~ was not at fault <br />even. though the stop work order was placed on him. <br /> <br />There being no further comments from the public, it was moved-' by~ Cuuncil- <br />man Gerton and seconded by Councilman Spiliotopoulos that the public <br />hearing be closed. <br /> <br />The roll call vote was as follows: <br /> <br />AYES: Councilmen Beratlis, Gerton, Pearson, Spiliotopoulos and Mayor <br />NOES: None ... Reid <br />ABSENT: None <br /> <br />After considerable discussion on this~matter,it was moved by Council- <br />man Gerton and seconded by CouncilmanBeratlis that a variance be <br />granted for Lot 17 with the condition. that an electric-or roll-up <br />garage door is installed. <br /> <br />The roll call vote was as follows: <br /> <br />AYES: Councilmen Bezatlis, Gerton, Pearson and Spiliotopoulos <br />NOES: Mayor Reid <br />ABSENT: None <br /> <br />The staff was instructed to continue this matter for one week to try <br />to solve the problem of the garage set back on Lots 4 and 13, <br /> <br /> 2. 2-28-72 <br /> <br /> <br />
