Mr~ Castro explained the original application had been approved as a car <br /> wash as the primary use, with gasoline secondary. <br /> <br /> Mro Edgar stated this was a question of whether or not the original condi- <br /> tions of the Signing Ordinance should be adhered to. <br /> <br /> It was moved by Councilman Kinney, and seconded by Councilman Herlihy, that <br /> the appeal of Filice-Vernazza Distributors, Inc., from an adverse decision of the <br /> Design Review Committee in denying application for sign wording change from the <br /> previous "76 Gasoline" to indicate "Shell Gasoline - 33-9/10", at the Robo Car <br /> Wash establishment at 915 Santa Riga Road, be denied. <br /> The roll call vote was as follows: <br /> AYES: Councilmen Herlihy, Kinney, Mori, and Mayor Reid <br /> NOES: Councilman Pearson <br /> ABSENT: None <br /> <br /> MATTERS CONTINUED FOR DECISION <br /> Report of the Director of Park and Recreation regarding Proposed Policy Re: <br /> Tree and Fence Report <br /> Mr. Patton reviewed his staff report regarding this matter, and the Park <br /> and Recreation Commission exceptions to his report. <br /> <br /> Mr. Campbell stated the City policy regarding repair of sidewalks and fences <br /> as being the responsibility of the homeowners, with cooperation from the City in <br /> isolated instances. <br /> <br /> It was moved by Councilman Kinney, and seconded by Councilman Pearson, that <br /> Resolution No. 73-17, approving the report of the Director of Parks and Recrea- <br /> tion, dated January 23, 1973, amended to read as follows: <br /> <br />1. Authorize the staff to remove all dead or nearly dead and hazardous trees <br /> as they occur within the community, while keeping intact the current policy <br /> of requiring specific Council approval for the removal of any healthy trees, <br /> and provide in conjunction a tree replacement program. <br /> <br /> That the City Council authorize a sum of money, to be determined by a report <br /> that will be presented 2-20-73 for approval, for replacement of trees on <br /> Hopyard Road and Valley Avenue. <br /> <br />3. That is be firmly established that each adjacent property owner shall be <br /> responsible for any sidewalk damage. <br /> <br /> That the question o£ hiring a municipal forester, plus the purchase of the <br /> required capital equipment ~or a year around structural pruning program be <br /> referred to the preparation of the City Manager's 1973-74 Budget. <br /> <br /> That the selection of specified tree species for each major boulevard and <br /> the Central Business District be referred to the Staff Planning Review <br /> Committee for determination o£' the staff concensus recommendation and then <br /> submitted to the ~Park and Reczeation Commission, followed by the Planning <br /> Commission and ~hen ~o the City Council for final action. <br /> <br />6~ That the City Council adop~ ~he policy that it shall be the adjacent pro- <br /> perty owner's responsibility to repair any fence built as a part of the <br /> subdivision's tentative map requirement, or which was built on his own <br /> when said fence abuts a part or any other City property° <br /> <br />7~ Finally, that ~he City require anyone wishing to establish a gate in the <br /> fence between private property and City of Pleasanton property, to secure <br /> an encroachment permit. <br /> <br />be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmen Herlihy, Kinney, Mori, Pearson, and Mayor Reid <br />NOES: None <br />ABSENT: None <br /> <br /> 1/29/73 <br /> <br /> <br />
