Mr. Hirst stated the legal feasibility of rezoning this property would be <br />difficult due to the improvements that have already been installed. <br /> <br /> Mr. E. G. McDonald, President of Del Prado Homeowners Association, expressed <br />his concern regarding the commercial and multiple zoning and felt the City was <br />derelict in its duty in this area. <br /> <br /> Mr. McDonald introduced the following homeowners in Del Prado who spoke in <br />opposition to the commercial and multiple zoning: <br /> <br /> Mr. Frank Brandes commented regarding density, reputation of developer, <br />cabana club, and ultimate use of Purchase Parcel No. 3, and urged present pro- <br />blems be taken care of before more building is done. <br /> <br /> Mr. Gil gaines expressed concern regarding the shortage of schools and urged <br />the area be placed in a Study District. <br /> <br /> Mr. Jim Bowie stated his objection to the proposed density for the following <br />reasons: <br /> 1. No need - particularly the neighborhood shopping center. <br /> 2. Premise on which original zoning was determined. <br /> 3. Impact on property privacy. <br /> 4o Inconsistent zoning. <br /> 5. Since construction has not begun, rezoning should be considered. <br />Mr. Bowie asked that this area be placed in a Study District. <br /> <br /> Mr. Jim McDermott expressed his concern regarding schools, density, proposed <br />townhouses, and West Los Positas Interchange. <br /> <br /> Mrs. Mary Silva commented that there was a neighborhood shopping center with- <br />in walking distance of this Subdivision, and expressed concern about support of <br />another commercial center in the area. <br /> <br /> Mr. Charles Marshall stated he felt the builder had misrepresented the zoning <br />in the development regarding commercial and multiple. <br /> <br /> Mrs. Cheryl Duncan spoke regarding the integrity of the developer regarding <br />their commitment to the buyers with reference to the cabana club. <br /> <br /> Mrs. Judy Brandes stated there was no need for a neighborhood shopping center, <br />and commented on the cabana club, and urged that the area be placed in a Study <br />District. <br /> <br /> Mr. Ted Fairfield, MacKay and Somps, representing Mackay Homes, stated the <br />density has not been changed, there has been a reduction in dwelling units, the <br />garden apartments are exactly the same as those originally proposed, the cabana <br />club had not been built because of the sewer freeze, the 250 unit multiple <br />apartments would be built in two phases - the first to be completed by December, <br />1973, and the second phase about two years later, and the neighborhood shopping <br />center will not be built until the market warrants it. <br /> <br /> Mr. Edgar commen~ed that the cabana club has first priority on sewer permits <br />for the Mackay development, when permits are again granted. <br /> <br /> Mr. Edgar stated the question arises as to whether we are discussing pro- <br />blems pertaining to proper land use in which case the City should exercise <br />strong control at the proper stage, and we have already indicated that we are <br />at the last stage of the development process in this situation; or are we dis- <br />cussing problems related to development timetables in which case the decision <br />should be made in the private sector. <br /> <br /> It was moved by Councilman Kinney, and seconded by Councilman Mort, to re- <br />affirm the City Council position to permit the commercial and multiple develop- <br />ment to proceed as planned in the Mackay Subdivision, subject to the following <br />conditions: <br /> <br /> 4. 1/22/73 <br /> <br /> <br />
