It was moved by Councilman Kinney, and seconded by Councilman Reid, that Resolu- <br /> tion No. 73-144, approving plans and specifications for Ray Street alignment, and <br /> authorizing the staff to advertise for bids, be adopted. <br /> The roll call vote was as follows: <br /> AYES: Councilmen Kinney, Reid, and Mayor Pro Tem Mori <br /> NOES: None <br /> ABSENT: Councilman Herlihy and Mayor Pearson <br /> <br /> Matters for the Information of the Council <br /> There were no Matters for the Information of the Council presented at this meet- <br /> ing. <br /> <br /> REPORTS OF THE CITY ATTORNEY <br /> Report~ Re: P.T.C.W.D.-Assessment District No. 1~ Segregation of Assessment No. 23 <br /> Mr. Scheidig presented his report regarding this matter, stating that the City <br /> recently has been advised by Mr~ Robert Brunsell that there has been a segregation <br /> of Assessment No. 23 in the Pleasanton Township County Water District because of a <br /> sale, and it is necessary for the Council to adopt a resolution directing the <br /> Director of Public Works to make on file an amended assessment. <br /> <br /> It was moved by Councilman Reid, and seconded by Councilman Kinney, that Reso- <br /> lution No. 73-145, directing the Director of Public Works to prepare and file an <br /> amended assessment, Assessment District No. 1, Pleasanton Township County Water <br /> District, Alameda County, California, be adopted. <br /> The roll call vote was as follows: <br /> AYES: Councilmen Kinney, Reid, and Mayor Pro Tem Mori <br /> NOES: None <br /> ABSENT: Councilman Herlihy and Mayor Pearson <br /> <br /> Legislation <br /> Mr. Scheidig presented his report regarding this matter, stating that from time <br /> to time he would be receiving Legislative Bulletins from the League of California <br /> Cities and would review and make comments in the side margins and send to the City <br /> Council in order that they would be better advised of legislation which is being <br /> introduced in Sacramento and also to allow Council a better opportunity to advise <br /> him if they wish to oppose or support any bills of particular interest. <br /> <br /> Mr. Scheidig was instructed to place this matter on the agenda again on 9-12-73 <br /> for full Council consideration of the legislation submitted. <br /> <br /> Authorization to send Letter to V.C.S.D.~ Re: Joint Power.~. Agreement for Fire <br /> ~eSotiations <br /> Mr. Scheldig stated that V.C.S.D. has requested a letter similar to the one <br /> that we mailed to the City of Livermore stating the City Council would not invoke <br /> the Ratification provisions of the Joint Powers Agreement for negotiations with <br /> Firemen if V.C.S.D. reached settlement with its firefighters. <br /> <br /> It was moved by Councilman Kinney, and seconded by Councilman Reid, authorizing <br /> Mayor Pro Tem Mori to sign letter to V.C.S.D., stating that the City Council would <br /> not invoke the Ratification provisions of the Joint Powers Agreement for negotia- <br /> tions with Firemen if V.C.S.D. reached settlement with its firefighters. <br /> The roll call vote was as follows: <br /> AYES: Councilmen Kinney, Reid, and Mayor Pro TemMori <br /> NOES: None <br /> ABSENT: Councilman Herlthy and Mayor Pearson <br /> <br /> .status Repgrt, Re: Joint Powers Agreement to Implement the..7.a.lley-wide Water Mana~e- <br />.... ment Plan <br /> Mr. Scheidig stated that Pleasanton and V.C.S.D. have approved the revised Joint <br /> Powers Agreement with one minor change in wording regarding Budget "review" to Budget <br /> "information and comment". He further stated the City of Livermore had other problems <br /> with the Agreement. Specifically, Livermore was concerned about Capital expenditures <br /> and responsibilities of a party terminating its participation for Capital expendi- <br /> tures incurred during the five year withdrawal period. <br /> <br /> Mr. Scheidig advised the Council that the revised Joint Powers Agreement would <br /> be reviewed again by the Committee in two weeks. <br /> <br /> 6. 8/27/73 <br /> <br /> <br />
