Mr. Edgar presented Councilman Kinney's letter to the Environmental Protection <br /> Agency regarding their regulations and how they will adversely affect the City of <br /> Pleasanton. <br /> <br /> After discussion, it was moved by Councilman Kinney, and seconded by Councilman <br /> Reid that Resolution No. 73-187, authorizing the City Attorney to file a petition <br /> for review of the E.P.A. regulations, be adopted. <br /> The roll call vote was as follows: <br /> -- AYES: Councilmen Herlihy, Kinney, Mori, Reid, and Mayor Pearson <br /> NOES: None <br /> ABSENT: None <br /> <br /> REPORTS OF THE CITY ATTORNEY <br /> Report~ Re: Fisher Claim <br /> Mr. Scheidig stated that the City has received a claim relating to the death of <br /> Brian Fisher as the result of an automobile accident in the vicinity of Crestline <br /> Way in Pleasanton, and it is in order for the Council to deny this claim. <br /> <br /> It was moved by Councilman Kinney, and seconded by Councilman Reid, to deny <br /> the claim of Mr. and Mrs. Gerald C. Shark and refer the matter to the City Attorney for handling. <br /> The roll call vote was as follows: <br /> AYES: Councilmen Herlihy, Kinney, Mori, Reid, and Mayor Pearson <br /> NOES: None <br /> ABSENT: None <br /> <br /> Authorization ~o execute Joint Exercise of Powers A~Feement~ Re: Water Management <br /> Plan <br /> Mr. Scheidig presented the background regarding this matter and stated that <br /> in order to implement the above joint powers agency, it is necessary for the Council <br /> to authorize execution of the above Joint Exercise of Powers Agreement. <br /> <br /> It was moved by Councilman Reid, and seconded by Councilman Mori, authorizing <br /> the proper City officials to execute the Joint Exercise of Powers Agreement to <br /> implement the Valley-wide Water Management Plan. <br /> The roll call vote was as follows: <br /> AYES: Councilmen Kinney, Mori, Reid, and Mayor Pearson <br /> NOES: Councilman Herlihy <br /> ABSENT: None <br /> <br /> Councilman Herlihy stated he felt the Joint Exercise of Powers Agreement <br /> would not succeed because of political aversions, and stated he felt a non- <br /> political body could better solve the water management problems. <br /> <br /> COMMUNICATIONS <br /> Letter from H. C. Elliott~ Inc.~ Re: Tracts 3327~ .3328~ 3328 and 3187 <br /> Mr. Edgar presented a letter from H. C. Elliott, Inc., dated November 21, 1973, <br /> regarding sewage treatment for Tracts 3327, 3328, 3329, and Tract 3187, in Vintage <br /> Hills, and a proposal from Pacific Hydro to upgrade the Sunol Plant. <br /> <br /> Mr. H. C. Elliott urged the City Council to consider the Pacific Hydro proposal <br /> as a viable solution to the sewage problem. <br /> <br /> The City Council authorized staff to proceed to investigate the Pacific Hydro <br /> proposal and report back to the Council. <br /> <br /> 6. 12/3/73 <br /> <br /> <br />
